    ¿Qué significa ser dependiente?

    A efectos tributarios, un dependiente es una persona "distinta del contribuyente o del cónyuge" que puede ser reclamada por otra persona en una declaración de impuestos. Un dependiente es alguien que depende de otra persona para su sustento financiero. Por lo general, esto incluye a tus hijos u otros familiares. También puede incluir a personas que no están directamente relacionadas contigo, como una pareja doméstica.

    Cuando identificas a alguien como dependiente en tu declaración de impuestos, informas al IRS que cumpliste con los requisitos para reclamar a esa persona como dependiente.

    ¿Por qué reclamar a alguien como dependiente?

    Si tienes familia, debes conocer el concepto de "dependiente" según el IRS para los fines del impuesto sobre los ingresos. ¿Por qué? Porque podrías ahorrarte miles de dólares en impuestos.

    Para los años tributarios anteriores a 2018, por cada dependiente calificado reclamado, podías lograr una reducción de ingresos sujetos a impuestos que se limitaba a la cantidad de la exención, que era de $4,050 en 2017. En 2025, las deducciones por exenciones se reemplazan por lo siguiente:

    • Una mayor deducción estándar
    • Un mayor Crédito Tributario por Hijos (por un valor de hasta $2,200 por cada hijo calificado para el 2025)
    • Un mayor Crédito Tributario Adicional por Hijos (de hasta $1,700 por hijo calificado)
    • Un nuevo Crédito por Otros Dependientes, de hasta $500 por cada dependiente calificado (que no debe confundirse con el Crédito por Gastos de Cuidado de Hijos Menores y Dependientes)

    Las reglas sobre los dependientes también se aplican a otros beneficios, como los siguientes:

    Las reglas básicas no son complicadas, pero puede resultar difícil aplicarlas en ciertos contextos familiares. Esto aplica en particular si tienes un hijo que se mudó para asistir a la universidad, un primo que vive contigo durante el verano o una hija con un trabajo de tiempo parcial. Las preguntas que figuran a continuación te ayudarán a decidir a qué familiares puedes reclamar como dependientes.

    ¿Qué hace que alguien califique como dependiente?

    Las reglas del IRS (Servicio de Impuestos Internos) para dependientes calificados cubren muchas situaciones.

    Afortunadamente, la mayoría de las personas tenemos vidas sencillas. Las reglas básicas abarcarán casi todos los casos. Para que las entiendas mejor, te explicamos todos los detalles.

    Existen dos tipos de dependientes, y cada uno está sujeto a reglas diferentes:

    • Un hijo calificado
    • Un pariente calificado

    Para ambos tipos de dependientes, tendrás que responder las siguientes preguntas a fin de determinar si puedes reclamarlos. 

    • ¿Son ciudadanos o residentes? La persona tiene que ser ciudadana estadounidense, estadounidense nativa o residente de los EE. UU., Canadá o México. Muchas personas se preguntan si pueden reclamar a un estudiante extranjero de intercambio con quien conviven temporalmente. La respuesta es "tal vez", pero solo si cumple con este requisito. Hay ciertas excepciones para los hijos adoptivos.
    • ¿Eres la única persona que lo reclama como dependiente? No puedes reclamar a alguien que se reclama como dependiente en otra declaración de impuestos. Tampoco puedes reclamar a una persona que declara que no puede ser reclamada como dependiente en su propia declaración de impuestos (toma una exención personal para sí misma). Por último, un dependiente no puede reclamar a otra persona como dependiente en su propio formulario de impuestos. Por lo general, estos requisitos se aplican a los hijos de padres divorciados. En este caso, tienes que usar las "reglas de desempate", que se encuentran en la Publicación 501 del IRS. En estas reglas, se establecen los requisitos de ingresos, parentesco y residencia para reclamar a un hijo.
    • ¿Presentan una declaración conjunta? No puedes reclamar a alguien que está casado y que presenta una declaración de impuestos conjunta. Supongamos que mantienes a tu hijo adolescente que está casado. Si él presenta una declaración conjunta con su cónyuge, no puedes reclamarlo como dependiente. Esta regla no se aplica si el dependiente presenta una declaración conjunta solo para reclamar un reembolso de impuestos retenidos sobre los ingresos o de cualquier impuesto estimado que haya pagado.

    Hijo calificado

    Además de los requisitos indicados anteriormente, para reclamar a un hijo calificado, tienes que poder responder afirmativamente a todas las siguientes preguntas. 

    • ¿Tiene un vínculo familiar contigo? El menor puede ser tu hijo/a, hijastro/a, hijo/a de crianza, hermano/a, medio hermano/a, hermanastro/a, hijo/a adoptivo/a o descendiente de uno de ellos.
    • ¿Cumple el requisito de edad? Tiene que ser menor de 19 años o, si es un estudiante de tiempo completo, menor de 24 años. Si tu hijo tiene una discapacidad total y permanente, el límite de edad no se aplica.
    • ¿Vive contigo? Tu hijo tiene que vivir contigo durante más de la mitad del año, pero se aplican varias excepciones.
    • ¿Lo mantienes financieramente? Tu hijo podría tener un trabajo, pero no puede proporcionar más de la mitad de su propio sustento financiero.

    Pariente calificado

    Muchas personas mantienen a sus padres ancianos. Sin embargo, proporcionar cierto sustento financiero no significa que puedas reclamar a uno de tus padres como dependiente. Esta es una lista de verificación para determinar si uno de tus padres (u otro familiar) califica.

    • ¿Vive contigo? Tu familiar debe vivir contigo todo el año como miembro de tu hogar o estar en la lista de "familiares que no viven contigo" en la Publicación 501. Alrededor de 30 tipos de familiares se incluyen en esta lista.
    • ¿Ganó menos de $5,200 en 2025 ($5,050 para 2024)? Si tu familiar tiene un ingreso bruto superior a $5,200 en 2025 no puedes reclamarlo como dependiente. Este límite aumentó de $5,050 en el 2024. Ciertos ingresos están excluidos de este requisito, como la totalidad o parte de los beneficios de Seguro Social.
    • ¿Lo mantienes financieramente? Tienes que proporcionarle más de la mitad de su sustento financiero total del año.

    En todos los casos, para reclamar a alguien como dependiente en tu declaración de impuestos, tú no puedes ser reclamado como dependiente en la declaración de otra persona.

    Ejemplos de reclamación de dependientes

    Contribuyentes casados con dos hijos menores de edad

    Supongamos que presentas tu declaración de forma conjunta con tu cónyuge. Tienes dos hijos menores de edad que no perciben ingresos y viven contigo durante más de la mitad del año (aunque se aplican algunas excepciones). En este caso, es probable que puedas reclamarlos como hijos dependientes calificados en tu declaración de impuestos.

    Contribuyentes divorciados con dos hijos menores de edad

    Piensa en el siguiente caso. Estás divorciado/a y tienes un acuerdo de custodia vigente entre tú y tu excónyuge para tus dos hijos. Quién puede reclamar a estos hijos en su declaración de impuestos dependerá de quién cumpla los criterios establecidos por el IRS (Servicio de Impuestos Internos) para reclamar a un/a hijo/a dependiente. Por lo general, la persona con la que los niños vivan más de la mitad del año podrá reclamarlos como dependientes en su declaración de impuestos. No obstante, puede haber un acuerdo legal independiente que estipule que el otro de los padres puede reclamar a los hijos como dependientes.

    Varios hermanos mantienen a un progenitor adulto mayor mediante un acuerdo de sustento financiero múltiple

    A veces, varios hijos adultos mantienen a un progenitor adulto mayor. Por lo general, el/la hijo/a que proporciona más del 50 % de su sustento financiero puede reclamar a la persona como dependiente. Sin embargo, puedes recurrir a un acuerdo de sustento financiero múltiple para determinar qué hermano/a puede reclamar al progenitor adulto 

    mayor en una declaración de impuestos. Incluso en esta situación, tendrás que aportar al menos el 10 % de su sustento financiero, pero esto queda muy por debajo del 50 % estándar.

    Reclamar a una pareja doméstica registrada

    Puedes reclamar a tu pareja doméstica registrada como dependiente si cumple con los requisitos establecidos en la categoría de pariente dependiente calificado. Reclamar a una pareja doméstica puede ser un desafío. Esto se debe a la baja cantidad de ingresos que la pareja puede obtener antes de dejar de ser elegible.

    Deducciones y créditos disponibles cuando se reclaman dependientes

    • Crédito Tributario por Ingreso del Trabajo: El Crédito Tributario por Ingreso del Trabajo es el mayor programa de sustento financiero para los trabajadores con ingresos bajos o moderados. Este crédito es reembolsable. Eso significa que puede reducir el impuesto sobre el ingreso y, a menudo, aumentar los reembolsos de impuestos para contribuyentes con ingresos bajos a moderados. El crédito puede ser de hasta $8,046 para una familia con tres o más hijos en el año tributario 2025. Esta cantidad aumentó de $7,830 en el 2024. Para recibir el crédito, no tienes que tener hijos necesariamente. Sin embargo, la cantidad del crédito suele ser mayor para aquellos contribuyentes que tienen hijos calificados.
    • Crédito por Gastos de Cuidado de Hijos Menores y Dependientes: Este también es un crédito tributario reembolsable. Ayuda a los padres a pagar la guardería de un dependiente calificado mientras trabajan o estudian, o si se trata de un padre que no puede cuidar de sí mismo. El crédito puede ser de entre el 20 % y el 50 % de los gastos, hasta un máximo de $6,000.

    Crédito Tributario por Hijos y Crédito Tributario Adicional por Hijos: El Crédito Tributario por Hijos es de hasta $2,200 por cada hijo/a calificado/a menor de 17 años en el 2025. En 2021, el Crédito Tributario por Hijos es de $3,600 por cada hijo/a calificado/a menor de 6 años y de hasta $3,000 por los hijos calificados de 6 a 17 años. Estos nuevos cambios provienen del Plan de Rescate Americano y están permitidos para contribuyentes solteros y casados que presentan la declaración por separado que ganan hasta $75,000 por año (o hasta $150,000 en el caso de los contribuyentes conjuntos). Si tus ingresos están por encima de estos límites, sigues siendo elegible para el Crédito Tributario Adicional por Hijos, que asciende a $2,200 por hijo e incluye los ingresos del Crédito Tributario en el 2025. 

    • por Hijos original y las cantidades para la eliminación gradual. Además, el crédito completo es totalmente reembolsable para 2021.
    • Crédito por Otros Dependientes: Si tienes un pariente que califica como dependiente en tu declaración de impuestos, tienes derecho a reclamar un crédito no reembolsable de hasta $500. Puedes hacer esta reclamación por cada pariente calificado que incluyas en tu declaración de impuestos.
    • Crédito por Adopción: El Crédito por Adopción de 2025 es un crédito tributario no reembolsable por un valor de hasta $17,280 de los gastos que hayas pagado por la adopción de un/a niño/a que no sea tu hijastro/a. Comezando en el 2025, hasta $5,000 de este crédito son rembolsables debido a los cambios de la ley "One Big Beautiful Bill". Las cantidades no utilizadas pueden ser aplicadas hasta 5 años posteriores. Este crédito aumentó de $16,810 en el 2024. El crédito no es reembolsable. Sin embargo, puedes trasladar el valor restante del crédito sin utilizar durante un máximo de cinco años. La cantidad del Crédito por Adopción que puedes reclamar guarda relación con lo que hayas gastado en la adopción. Por ejemplo, si tus gastos de adopción calificados son de $7,000 en 2025, no puedes reclamar el crédito completo de $17,280 . Del mismo modo, si tus gastos de adopción ascienden a $20,000, solo puedes reclamar hasta $17,280 , que es el límite del crédito.
    • Gastos médicos: Si pagaste los gastos médicos de tu hijo o pariente dependiente calificado, es posible que puedas reclamarlos como deducción. Debes cumplir las reglas sobre la deducción de gastos médicos. Por lo general, puedes deducir los gastos médicos calificados no reembolsados que superen el 7.5 % de tu ingreso bruto ajustado. Reclamar esta deducción también implica que debes detallar tus deducciones en el Anexo A. Como resultado, no puedes reclamar la deducción estándar.
    • Crédito Tributario de la Oportunidad Americana y Crédito Perpetuo por Aprendizaje: Estos dos créditos tributarios están destinados a cubrir parte del costo relacionado con gastos de educación calificados. Pueden ser para ti, tu cónyuge o tus dependientes mientras estén inscritos en la universidad, en una escuela vocacional o en determinadas capacitaciones relacionadas con el trabajo.

    ¿Quién no se considera dependiente?

    Para ser un/a hijo/a calificado/a, el/la hijo/a debe cumplir cinco requisitos: edad, parentesco, residencia, sustento financiero y declaración conjunta. El incumplimiento de cualquiera de estos requisitos significa que el/la hijo/a no se puede considerar dependiente. 

    Un/a hijo/a con una discapacidad permanente y total en cualquier momento durante el año califica como hijo/a dependiente, sin importar su edad. De lo contrario, de acuerdo con el requisito de edad del IRS, el/la hijo/a debe ser:

    • Menor de 19 años al final del año calendario (si no es estudiante)
    • Más joven que tú (o tu cónyuge si presentan su declaración de forma conjunta)

    Si el/la hijo/a es estudiante de tiempo completo durante al menos cinco meses del año, el requisito de edad es diferente. El estudiante debe ser:

    • Menor de 24 años al finalizar el año
    • Más joven que tú (o tu cónyuge si presentan su declaración de forma conjunta)

    Ejemplos de requisito de edad:

    Tu hijo no es estudiante y cumple 19 años el 1 de diciembre. Tu hijo no cumple el requisito de edad.

    Tu hija es estudiante de tiempo completo y cumple 24 años el 1 de diciembre. Tu hija no cumple el requisito de edad.

    Tu hermano es un estudiante soltero de 22 años que vive contigo y recibe de ti más de la mitad de su sustento financiero. Tú y tu cónyuge tienen 21 años y presentan una declaración conjunta. Tu hermano no cumple el requisito de edad porque no es menor que tú o tu cónyuge.

    Tu hermana es una estudiante soltera de 22 años que vive contigo y recibe de ti más de la mitad de su sustento financiero. Tu cónyuge tiene 23 años y presentas una declaración conjunta. Tu hermana cumple el requisito de edad porque es más joven que tu cónyuge.

    Además del requisito de edad, se deben cumplir otros requisitos para calificar como dependiente. Se incluye lo siguiente:

    •  Requisito de parentesco. Para calificar, un/a niño/a debe ser tu hijo/a, hijastro/a o hijo/a de crianza, o un/a descendiente de cualquiera de ellos (por ejemplo, tu 
      • nieto/a); o tu hermano/a, medio hermano/a, hermanastro/a, o un descendiente de cualquiera de ellos. Los hijos adoptivos califican como tus propios hijos.

      Ejemplo: Tu sobrina vive contigo y recibe sustento financiero de tu parte. Cumple con el requisito de parentesco porque es descendiente de tu hermano/a.

      • Requisito de residencia. Por lo general, el menor debe haber vivido contigo durante más de la mitad del año. Hay ciertas excepciones para los hijos que nacieron o fallecieron durante el año y otras situaciones.

      Ejemplo: Tu hijo vive contigo tres meses al año y no cumple ninguna de las excepciones. Tu hijo no califica como dependiente.

      • Requisito de sustento. El/la hijo/a no puede haber proporcionado más de la mitad de su propio sustento financiero durante el año.

      Ejemplo: Proporcionaste $5,000 para el sustento financiero de tu hija de 18 años durante el año, y ella aportó $7,500, con los cuales completó el total de su sustento financiero. Tu hija no es una hija calificada porque proporcionó más de la mitad de su propio sustento financiero.

      •  Requisito de declaración conjunta. Tu hijo/a no puede presentar una declaración conjunta para el año, a menos que tu hijo/a y su cónyuge presenten una declaración conjunta solo para reclamar un reembolso del impuesto sobre el ingreso retenido o del impuesto estimado pagado.

      Ejemplo: Tu hija casada y su cónyuge presentaron una declaración conjunta y debían impuestos. Tu hija no es una hija calificada porque presentó una declaración conjunta no solo para recibir un reembolso.

      ¿Cómo puedo reclamar a un dependiente en mis formularios de impuestos?

      Los dependientes se reclaman en la primera página del Formulario 1040. Asegúrate de tener a mano sus nombres completos, edades y números de Seguro Social. Para reclamar a tus dependientes:

      1.  Ingresa su nombre completo en la primera página del Formulario 1040.
      2.  Ingresa su número de Seguro Social.
      3.  Indica su parentesco contigo.
      4.  Si tienes más de cuatro dependientes, marca la casilla correspondiente e incluye su información en una página separada.

      Asegúrate de que tu dependiente cumpla con los requisitos del IRS. Por lo general, el IRS (Servicio de Impuestos Internos) exige que el hijo sea menor de 19 años (o menor de 24 años si es estudiante de tiempo completo), viva contigo durante más de la mitad del año y no proporcione más de la mitad de su propio sustento financiero.

Puedes reclamar como dependiente en tu declaración de impuestos a una pareja doméstica registrada siempre que cumpla con los requisitos.
