El Formulario 1099 consta de una serie de documentos a los que el IRS (Servicio de Impuestos Internos) se refiere como “declaración informativas”. Existen varios Formularios 1099 diferentes en los que se reportan los diversos tipos de pagos que puedes recibir durante todo el año, además de lo que una empresa pueda pagarte.

¿Qué es el Formulario 1099 del IRS?

El Formulario 1099 del IRS es un conjunto de formularios de impuestos que documentan diferentes tipos de pagos realizados por una persona o una empresa que, por lo general, no es tu empleador. El pagador completa el formulario con los detalles que corresponden y les envía copias a ti y al IRS con el reporte de los pagos realizados durante el año tributario. En algunos casos, también es necesario enviar una copia a la autoridad tributaria estatal. El pagador es responsable de completar el Formulario de impuestos 1099 correspondiente y de enviártelo. Dichos pagos pueden ser por ingresos de alquiler, ganancias obtenidas como trabajador por cuenta propia o contratista independiente, un reembolso de impuestos recibido de tu estado o localidad, ganancias por apuestas y más.  La mayoría de los Formularios 1099 deben entregarse a más tardar el 31 de enero, pero, en algunos casos, la fecha límite es el 15 de febrero.

¿Para qué se utiliza el Formulario 1099?

El Formulario 1099 es utilizado para documentar diferentes tipos de pagos de parte de alguien que generalmente no es tu empleador. Este puede ser un individuo, negocio o entidad, como lo es el gobierno. Hay diferentes Formularios 1099 que reportan varios tipos de ingresos y como fueron ganados, tales como, por ejemplo, apuestas, intereses, dividendos, compensación para personas que no son empleados, o distribuciones de un plan de retiro.

Si recibes un Formulario 1099, es tu responsabilidad reportar el ingreso ganado en tu declaración de impuestos.

Ejemplos de cuando puedes recibir un Formulario 1099

Algunos ejemplos comunes de cuando puedes recibir un Formulario 1099:

  • Si recibiste $600 o más como persona que no es empleado de una persona o negocio que típicamente no es tu empleador, debes recibir un Formulario 1099-NEC
  • Si recibiste $600 o más en pagos de alquiler o regalías, debes recibir un Formulario 1099-MISC
  • Si recibes un reembolso de impuestos local o estatal durante el año previo, puedes esperar recibir el Formulario 1099-G

Del mismo modo, si pagaste a un trabajador por cuenta propia, contratista independiente u otro trabajador que no es empleado $600 o más durante el año en relación con tu actividad o negocio, es probable que debas enviarle un Formulario 1099-NEC.

¿Quién envía los Formularios 1099?

Existen varios tipos de Formularios 1099 para documentar los pagos que una persona o empresa realiza a otra parte. Como los pagos se registran en Formularios 1099, muchas personas pueden recibir varios Formularios 1099 por diferentes motivos.

Uno de los Formularios 1099 más populares es el Formulario 1099-NEC que se usa para pagos de compensación de quienes no son empleados. Por ejemplo, si eres contratista independiente o trabajador por cuenta propia, podrías recibir un Formulario 1099-NEC que documente los pagos que recibiste de un pagador en particular a lo largo del año.

Los pagos de compensación de quienes no son empleados inferiores a $600 no requieren que se presente el Formulario 1099-NEC, aunque el pagador puede optar por hacerlo.

Nota de TurboTax:

El Formulario 1099-NEC debe incluir los pagos que recibes si son de $600 o más y provienen de un mismo pagador. Ese es el límite que indica que un pagador debe presentar un Formulario 1099-NEC.

 

¿Cuándo debes esperar tener que enviar o recibir una 1099?

Hay diferentes fechas de vencimiento para los distintos tipos de Formularios 1099. Por ejemplo, el Formulario 1099-NEC, que suele usarse para reportar los pagos que recibes si eres contratista independiente o trabajador por cuenta propia, debe presentarse a más tardar el 31 de enero. Si el 31 de enero no es un día hábil, la fecha de vencimiento se traslada al próximo día hábil.

Si eres tú quien envía los Formularios 1099, se aplica lo siguiente:

  1. La mayoría de los Formularios 1099 deben llegar al destinatario a más tardar el 31 de enero.
  2. Si vas a enviar al IRS un formulario impreso, por lo general, debes enviar el Formulario 1099 a más tardar el 28 de febrero (sellado a más tardar en esa fecha).
  3. Si estás usando un software de impuestos como TurboTax para enviar los formularios al IRS, importaremos la información que debe incluir el formulario por ti, y tienes hasta el 31 de marzo para presentarlo electrónicamente, lo que significa que la presentación electrónica de una declaración te dará más tiempo para preparar el formulario que enviar un formulario impreso por correo postal.
  4. Los Formularios 1099-NEC deben enviarse a los destinatarios y al IRS a más tardar el 31 de enero, independientemente de si se presentan de manera electrónica o en papel.

Los pagadores deben enviarte estos formularios a principios de la temporada de preparación de impuestos para que tengas tiempo de preparar tu declaración y para que el IRS tenga pruebas de la cantidad de ingresos que obtuviste durante el año tributario.

A pesar de las fechas de vencimiento tempranas para enviar estos formularios como pagador, no tendrás que presentar tu propia declaración de impuestos hasta la fecha límite de la presentación.

Las fechas de vencimiento tempranas para enviar los Formularios 1099 al IRS permiten que se detecte el fraude de reembolso con mayor facilidad al poder verificar los ingresos que las personas reportan en sus declaraciones de impuestos. La mayoría de los Formularios 1099 deben presentarse al IRS a más tardar el 28 de febrero si se envían por correo postal o el 31 de marzo si se presentan electrónicamente.

Los Formularios 1099 más comunes: 1099-NEC y 1099-MISC

1099-NEC: Compensación para persona que no es empleado

 

¿Para qué se usa? Para reportar la compensación de quienes no son empleados, como los ingresos obtenidos como contratista independiente, “freelancer” o trabajador por cuenta propia.

Fecha de vencimiento para el destinatario: 1 de febrero

 

Fecha de vencimiento para el IRS: 1 de febrero

Ejemplo: Trabajaste como chofer de viajes compartidos, repartidor de comida, escritor independiente o realizaste cualquier otro tipo de actividad como trabajador por cuenta propia o contratista independiente.

1099-MISC: Información adicional

 

¿Para qué se usa? Para los pagos que recibas en concepto de alquileres, regalías, premios y recompensas, pagos sustitutivos de dividendos, pagos médicos y de atención de la salud e ingresos de seguro de cosechas, entre otros.

Fecha de vencimiento para el destinatario: 31 de enero (o 16 de febrero si tiene dividendos sustitutos e intereses libres de impuestos reportables por corredores o ganancias brutas pagadas a un abogado)

 

Fecha de vencimiento para el IRS: 28 de febrero (o 31 de marzo si utiliza e-file)

Ejemplo: Pagos de alquiler recibidos por la propiedad que alquilas

Comparación del Formulario 1099-NEC con el Formulario 1099-MISC

¿Cuál es la diferencia entre los Formularios 1099-NEC y 1099-MISC? Antes del año tributario 2020, si eras propietario de una empresa en la que trabajaban contratistas, debías completar principalmente el Formulario 1099-MISC para reportar las compensaciones de quienes no son empleados. A partir de 2020, el IRS optó por reintroducir el Formulario 1099-NEC como la nueva forma de reportar los ingresos de trabajo por cuenta propia, en lugar de usar el Formulario 1099-MISC. Esto se hizo en parte para ayudar a aclarar que hay una fecha límite de presentación para la compensación de quienes no son empleados, que es diferente de la fecha límite para otros pagos que se reportan a través del Formulario 1099-MISC.

La compensación de quienes no son empleados puede incluir toda compensación recibida por cualquier servicio prestado siempre que no se te considere un empleado. En cambio, si eres empleado, tu compensación se suele reportar en un Formulario W-2.

Ahora, el Formulario 1099-NEC reporta la compensación de quienes no son empleados, pero el Formulario 1099-MISC sigue existiendo para reportar otros tipos de ingresos varios.

Otros tipos de Formularios 1099

1099-A: Adquisición o Abandono de Propiedad Bajo Hipoteca

 

¿Para qué se usa? Si se ejecutó tu propiedad durante el año tributario, puedes recibir este formulario de tu prestamista hipotecario en caso de que se haya cancelado parte o la totalidad de tu hipoteca, hayas perdido la propiedad o tu propiedad se haya vendido en una venta por un valor menor a la deuda hipotecaria.

Fecha de vencimiento para el destinatario (prestatario): 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

EjemploTu prestamista ejecutó tu vivienda y canceló tu hipoteca.

1099-B: Ingresos de un Corredor y Transacciones de Intercambio

 

¿Para qué se usa? Para reportar las ventas de acciones, bonos, derivados u otros títulos valores durante el año tributario a través de uno o varios corredores de bolsa.

Fecha de vencimiento para el destinatario: 15 de febrero (o 15 de marzo para los reportes por parte de fiduciarios e intermediarios de fideicomisos de inversión fija de amplia participación [WHFIT, por sus siglas en inglés]).

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Vendiste acciones en una cuenta de corretaje.

1099-C: Cancelación de Deuda

 

¿Para qué se usa? Para llegar a un acuerdo con un prestamista negociando la cancelación de una deuda.

Fecha de vencimiento para el destinatario: 31 de enero

 

Fecha de vencimiento para el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Llegaste a un acuerdo con tu prestamista para cancelar el total o parte de tu hipoteca.

1099-DIV: Dividendos y Distribuciones

 

¿Para qué se usa? Para recibir dividendos o ciertas distribuciones que, por lo general, provienen de inversiones.

Fecha de vencimiento para el destinatario: 31 de enero

 

Fecha de vencimiento para el IRS28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo si la declaración se presenta en línea con un software de impuestos.

Ejemplo: Dividendos de acciones

1099-G: Ciertos Pagos del Gobierno

 

¿Para qué se usa? Para reportar las compensaciones por desempleo, así como cualquier reembolso de impuestos estatales o locales sobre los ingresos durante el año.

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Reembolso de impuestos estatal de California

1099-INT: Ingreso por Intereses

 

¿Para qué se usa? Para recibir pagos de intereses y puede que tengas que pagar el impuesto sobre los ingresos por estos intereses, o tal vez no.  De todas formas, es posible que tengas que incluir la información de este formulario en tu declaración de impuestos.

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo si la declaración se presenta en línea con un software de impuestos.

Ejemplo: Intereses de cuentas de ahorro

1099-K: Pagos de Tarjeta y Transacciones con Redes de Pagos a Terceros

 

¿Para qué se usa? Para reportar pagos con tarjeta de crédito y el procesamiento de pagos de terceros recibidos a través de Internet en el caso de que dirijas un negocio como una tienda minorista en línea, tienda de comercio electrónico u otro negocio virtual.

Para el 2024, deberías recibir este formulario si tu actividad anual de procesamiento de tarjetas de crédito supera los $5,000 sin importar la cantidad de transacciones individuales. Para el año tributario 2023 y previos, deberías recibir este formulario si tu actividad anual de procesamiento de tarjetas de crédito supera los $20,000 y realizaste más de 200 transacciones individuales.

No hay límite para la cantidad de transacciones de pago con tarjeta.

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Diriges un sitio web de comercio electrónico que ganó más de $20,000  y tuviste más de 200 transacciones en 2023 a través de redes de pagos a terceros.

1099-LTC: Seguro de Atención a Largo Plazo y Beneficios Adelantados por Fallecimiento

 

¿Para qué se usa? Para reportar los pagos realizados según lo dispuesto en un contrato de seguro de cuidado a largo plazo y beneficios adelantados por fallecimiento pagados de conformidad con un contrato de seguro de vida o por un proveedor de servicios de liquidación de beneficios.

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Recibiste pagos de una póliza de seguro de cuidado a largo plazo.

1099-OID: Descuento de la Emisión Original

 

¿Para qué se usa? Si tienes bonos o certificados de depósito (CD) que se emitieron por una cantidad inferior al valor nominal, suele reconocerse como ingreso una parte de este descuento cada año hasta que el bono se canjea o alcanza su valor total al vencimiento. En el Formulario 1099-OID, se reporta esta cantidad anual.

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Realizaste inversiones en bonos a través de un corredor de bolsa y pagaste menos del valor nominal por ellos.

1099-Q: Pagos de Programas de Educación Calificados (Según las Secciones 529 y 530)

 

¿Para qué se usa? En este formulario, se reportan las distribuciones recibidas de programas de matrícula calificados y cuentas de ahorros para la educación (ESA, por sus siglas en inglés) Coverdell.

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Recibiste una distribución de un plan de ahorro 529 o de una cuenta Coverdell ESA.

1099-QA: Distribuciones de Cuentas ABLE

 

¿Para qué se usa? Este formulario proporciona información relacionada con las distribuciones de cuentas ABLE (Experiencia de Vida Mejorada)

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Recibiste una distribución de una cuenta ABLE.

1099-R: Distribuciones de Pensiones, Anualidades, Planes de Retiro, IRA, Contratos de Seguros, Etc.

 

¿Para qué se usa? Para recibir distribuciones de beneficios de jubilación tales como pensiones y anualidades de $10 o más.

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Recibiste una distribución de tu plan de jubilación.

1099-S: Ingresos por Transacciones de Bienes Raíces

 

¿Para qué se usa? En caso de que hayas vendido o intercambiado bienes raíces durante el año y hayas obtenido ganancias brutas por dicha venta o intercambio, o recibido determinados pagos de regalías.

Fecha de vencimiento para el destinatario: 15 de febrero

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Vendiste tu vivienda.

1099-SA: Distribuciones de HSA, Archer MSA, o Medicare Preferencial MSA

 

¿Para qué se usa? Si usaste fondos de un plan de ahorro para cuidado médico con ventajas tributarias, la institución que administra tu plan reportará las distribuciones a través del Formulario 1099-SA.

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Recibiste distribuciones de tu cuenta de ahorros para gastos médicos.

SSA-1099: Declaración de Beneficios del Seguro Social

 

¿Para qué se usa? Para reportar la cantidad de beneficios pagados y reintegrados, primas de Medicare y otras cantidades retenidas, así como los impuestos federales retenidos sobre los ingresos del año por beneficios de Seguro Social.

Fecha de vencimiento para el destinatario: 31 de enero.

 

Fecha de vencimiento ante el IRS: 28 de febrero en el caso de declaraciones impresas enviadas por correo postal. 31 de marzo en el caso de declaraciones presentadas electrónicamente con un software de impuestos.

Ejemplo: Recibiste beneficios del Seguro Social.

Qué hacer si no recibes todos tus formularios 1099

Aunque no tengas los formularios correspondientes, tienes la responsabilidad de pagar los impuestos que adeudas. Si no recibiste un Formulario 1099, tienes que reportar los ingresos recibidos en tu declaración de impuestos para evitar una factura del IRS por los impuestos adeudados y por las posibles multas.

Si no recibiste todos los Formularios 1099 antes de las fechas límite del 31 de enero o del 15 de febrero, comunícate con la persona o empresa responsable de enviarte dicho formulario. Solicita que te envíen una copia del Formulario 1099 para que puedas presentar tu declaración de impuestos a tiempo.

¿Puedo presentar un Formulario 1099 electrónicamente?

Sí, los formularios 1099 se pueden presentar electrónicamente.

Puedes presentar tu 1099 a través de software de impuestos o en papel. El presentar formularios de impuestos electrónicamente puede ofrecer varios beneficios, como:

¿Qué puedo hacer si hay un error en mi Formulario 1099?

Si recibes un Formulario 1099 con un error, contacta al negocio que lo envió lo antes posible. Pídele que corrijan el error. 

En algunos casos, podrían corregir el error antes de enviar la 1099 incorrecta al IRS. 

Si eres un empleador que presentó un Formulario 1099 incorrecto, tendrás que presentar un formulario corregido. Utiliza el mismo método que utilizaste para el formulario original. Una vez completado, envía una copia de destinatario al contratista para que pueda presentar sus impuestos.
