Principales deducciones de impuestos para trabajadores por cuenta propia

Ya sea que trabajes por contrato o tengas tu propia pequeña empresa, las deducciones de impuestos para trabajadores por cuenta propia pueden sumar grandes ahorros en impuestos.

  • Los planes de retiro para ti y tus empleados pueden ser una gran deducción. En el 2023, un individuo puede contribuir $22,500 (más $7,500 adicional para aquellos mayores de 50 años de edad) como un aplazamiento de 401(k), más 25 % de tu ingreso neto hasta un máximo total de $73,500. Para el 2024 el límite aumenta a $23,000 más un aportación de actualización de $7,500 con un máximo de $76,500.

  • Los gastos de viaje relacionados al negocio, depreciación de la propiedad y equipo, gastos de educación relacionados al negocio, gastos de publicidad y promoción, cuotas bancarias, comidas de restaurantes necesarias, entretenimiento y otros costos pudieran también ser deducibles.  

Deducciones del trabajo por cuenta propia

El trabajo por cuenta propia implica libertad, responsabilidad y muchos gastos. Si bien la mayoría de los trabajadores por cuenta propia celebran las dos primeras, sienten repulsión por la tercera, en especial, a la hora de presentar sus impuestos. Es posible que no conozcan algunas de las deducciones de impuestos que les corresponden.

Cuando llegue el momento de presentar las declaraciones, no dudes en reclamar los beneficios que tienes por ser el jefe. Como alguien que triunfa en el trabajo por cuenta propia, te los ganaste.

"Muchas veces, se suele pasar por alto la deducción de gastos de educación. Si haces cursos o compras material de investigación para mejorar tu efectividad en el trabajo, pueden ser deducibles".

Planes individuales de jubilación (cuentas IRA)

John L. Hillis, presidente de Hillis Financial Services en San José, California, dijo que la mejor deducción de impuestos para los trabajadores por cuenta propia es un plan de jubilación. Una persona que no tiene empleados puede establecer un plan 401 individual.

"En 2023, la persona puede aportar $22,500 al plan 401(k) como aplazamiento, más el 25 % de sus ingresos netos", comentó Hillis.

La cantidad máxima total para el 2023 es de $73,500 incluyendo una aportación de actualización adicional para aquellos tienen 50 años o más. Para el 2024, la contribución base aumenta a $23,000, la aportación de actualización se mantiene en $7,500; y la cantidad máxima total aumenta a $76,500.

Para quienes tienen empleados, Hillis recomendó el Plan de Incentivos de Ahorros para Empleados (SIMPLE, por sus siglas en inglés) IRA, un plan basado en una cuenta IRA que ofrece a los pequeños empleadores un método simplificado que les permite hacer aportaciones para la jubilación de sus empleados. A partir de 2023, un empleado puede aplazar hasta $14,000, según comentó Hillis, y los empleados mayores de 50 años pueden aportar $3,000 adicionales.

"Una tercera opción en planes de jubilación es el Plan Simplificado de Pensiones para Empleados IRA (SEP IRA)", agregó Hillis. "En 2023, el empleador puede aportar el 25 % de los ingresos o $66,000 (de ambos valores, el menor). Si el empleador tiene empleados elegibles, el porcentaje que aporta a cada empleado debe ser el mismo". Para el 2024 este límite aumenta a $69,000 y aumenta a un máximo de $76,500 con la aportación de actualización.  

Hillis afirmó que los planes de jubilación constituyen, sin duda, "la deducción n.°1. El Gobierno ayuda a reunir fondos para la jubilación".

Uso comercial del hogar o la vivienda

La contadora y asesora Jéneen R. Perkins, directora de Éclat Enterprises LLC en Milwaukee, Wisconsin, comentó que "la mayoría de los negocios de los contribuyentes que trabajan por cuenta propia comienzan como negocios en el hogar. Esas personas deben saber que parte de los costos comerciales son deducibles", agregó. "Es importante llevar un registro de los gastos relacionados con los costos de la vivienda.

Si los ingresos brutos provenientes de tu negocio superan tus gastos totales, puedes deducir todos los gastos relacionados con el uso comercial de tu hogar", explicó Perkins. Si tus ingresos brutos no superan tus gastos totales, podrás deducir solo la diferencia entre tus ingresos brutos y la suma de todos los gastos comerciales que pagarías si no tuvieras el negocio en tu hogar. Estos gastos podrían incluir líneas de teléfono, Internet y otros costos que surgen de las actividades comerciales.

Además, debes tener una oficina en el hogar que realmente uses para trabajar. Según comentó Hillis, el IRS (Servicio de Impuestos Internos) puede exigirte que lo documentes.

Deducción de gastos de automóvil

"Si viajas por negocios, incluso distancias cortas dentro de tu propia ciudad, puedes deducir en la declaración de impuestos el valor en dólares de las millas que recorriste para fines comerciales", explicó Perkins. El contribuyente puede reclamar el gasto real en el que incurrió o utilizar la tarifa estándar por milla que establece el IRS, que es de $0.655 a partir de 2023. La tarifa estándar para el 2024 aumenta a $0.67 por milla. Las tarifas por milla que autoriza el IRS se deben verificar todos los años, ya que pueden cambiar.

"Si decides usar los gastos reales del automóvil, asegúrate de incluir pagos, depreciación, matrícula, seguro, alquiler de cochera, licencias, reparaciones, mantenimiento, estacionamiento y peajes", aclaró Perkins. "Si decides usar la tarifa estándar por milla, lo mejor será llevar un registro (diario, semanal o mensual) de las millas recorridas, de tal modo que puedas distinguir el uso personal del uso comercial".

Depreciación de propiedades y equipos

"Es posible que algunos trabajadores por cuenta propia compren propiedades y equipos para un negocio. Si esperan que esa propiedad dure más de un año, deben incluir la depreciación en la declaración de impuestos", explicó Perkins.

Dijo Perkins que, según el IRS, las reclamaciones relacionadas con las propiedades deben cumplir con los siguientes criterios: Debes ser el dueño de la propiedad, y esta se debe usar o conservar para generar ingresos. La propiedad debe tener una vida útil estimada, es decir, debes poder calcular cuánto tiempo podrás generar ingresos con ella. La propiedad no puede tener una vida útil de un año o menos, ni puedes comprarla y venderla dentro del mismo año.

Además, puedes deducir determinadas reparaciones que hagas en la propiedad que usas para fines comerciales.

Gastos de educación

Todos los gastos de educación son potencialmente deducibles.

"Muchas veces, se suele pasar por alto la deducción de gastos de educación", comentó Hillis. "Si haces cursos o compras material de investigación para mejorar tu efectividad en el trabajo, pueden ser deducibles".

Piensa en libros, cursos virtuales, cursos en institutos locales u otras clases o materiales que hayas comprado para mejorar tu trabajo o tu negocio. Es fácil olvidar un seminario web o un libro electrónico de negocios que compraste en línea, así que guarda los recibos electrónicos.

Perkins también mencionó las suscripciones a publicaciones especializadas o profesionales y las donaciones a organizaciones comerciales, ambas muchas veces necesarias para la continuidad y el crecimiento de tu negocio.

Otras áreas que explorar

Otras deducciones que se pueden pasar por alto fácilmente son los gastos para fines publicitarios o promocionales, las comisiones bancarias y los boletos de avión, autobús o tren. Las comidas en restaurantes y otros gastos de entretenimiento se pueden deducir siempre y cuando sean gastos comerciales necesarios.

Además, Hillis aconseja considerar las primas de seguro médico, que, en la mayoría de los casos, representan un crédito y no una deducción.

"Un crédito reduce directamente los impuestos en lugar de reducir los ingresos", comentó.

Independientemente de qué gastos descubras que puedes deducir, lo más importante es que lleves registros exactos durante todo el año. Conserva los recibos, incluso los que te envíen por correo electrónico, y archívalos o regístralos para que puedas acceder a ellos fácilmente a la hora de presentar tus impuestos. Conservar recibos, registrar millas y anotar otros gastos no solo facilita la presentación de tu declaración, sino que te proporciona un sistema que te permite ver los cambios de un año a otro.

Estrategias para ahorrar en impuestos a largo plazo

Cuando consideres las deducciones para el trabajo por cuenta propia, no mires solo las de último momento. Piensa en implementar algunas estrategias a largo plazo que te permitan ahorrar dinero año tras año, en especial, si tienes ingresos altos.

"Los contadores suelen decirte lo que tienes que pagar", comenta Stephen K. Davis, asesor principal de inversiones de Safe Harbor Asset Management en Huntington, Nueva York. "No siempre te hablan sobre las estrategias para pagar menos.

A fin de reducir tus ingresos brutos sujetos a impuestos, considera establecer un plan de pensión de beneficios definidos", explicó Davis. Este plan depende de tu edad y de tus ingresos: cuanto mayor seas y más altos sean tus ingresos, mayor será el monto que puedas aportar. Como alternativa, está el plan de participación en las ganancias ponderado por la edad, que es similar y puede beneficiar a quienes tienen varios empleados.

Otra estrategia para propietarios de negocios que generan ingresos altos y poseen sus propios edificios a través de una sociedad de responsabilidad limitada o una estructura comercial similar consiste en pagarse a sí mismos una renta, explica Davis. Esta renta se utiliza para pagar la hipoteca, pero también se considera como gasto comercial para fines tributarios.

Los profesionales que trabajan por cuenta propia a quienes se les exige tener un seguro de responsabilidad civil deben considerar constituir su propia compañía de seguros. Davis nos advierte que, si el dinero se acumula y las reclamaciones son mínimas, el dinero que se retira es tributable como ganancias de capital. Davis hizo hincapié en que no es una estrategia de jubilación, pero puede ahorrarte dinero, ya que te permite "pagarte a ti mismo" en lugar de a una compañía de seguros y, aun así, deducir las primas.
