¿Por qué solicitar una prórroga?

La presentación de una solicitud de prórroga pospone automáticamente la fecha límite de presentación de impuestos y te protege de posibles multas por presentación tardía, que pueden ir acumulándose a una tasa del 5% de la cantidad adeudada en tu declaración por cada mes que declares tarde.

  • Por ejemplo, si debes $2,500 y te has atrasado tres meses, la multa por presentación tardía sería de $375. ($2,500 x 0.05) x 3 = $375
  • Si te atrasaste más de 60 días, la multa mínima es de $100 o el 100% del impuesto que debes según la declaración (de ambos importes, el que sea menor).
  • Solicitar una prórroga elimina la multa por presentación tardía hasta la fecha límite de la prórroga.

¿Cuánto dura la prórroga?

Si solicitaste una prórroga antes del 15 de abril de 2024 (fecha límite para la presentación del año tributario 2023), la fecha límite para la presentación de impuestos se extiende hasta el 15 de octubre de 2024.

  • Una prórroga para presentar tu declaración no implica que tengas más tiempo para pagar tus impuestos.
  • Si esperas adeudar dinero, debes realizar un cálculo estimado de esa cantidad y pagarla con tu Formulario 4868.

¿Qué sucede si no solicité una prórroga?

Las consecuencias varían dependiendo de si debes dinero al IRS o si el IRS te debe un reembolso a ti.

Si estás por recibir un reembolso:

Este es uno de los pequeños grandes secretos sobre la ley federal de impuestos. Si esperas recibir un reembolso de impuestos de parte del IRS (como sucede con aproximadamente tres de cada cuatro contribuyentes cada año), entonces no hay multa por no presentar tu declaración de impuestos a más tardar en la fecha límite, aunque no solicites una prórroga. Sin embargo, quizás no suceda lo mismo con los impuestos estatales.

Eso no quiere decir que no haya buenas razones para realizar la presentación a tiempo. Aunque estés esperando un reembolso, ten en cuenta lo siguiente:

  • No podrás recuperar tu dinero hasta que realices la presentación, así que debes presentar la declaración cuanto antes para recibir el dinero lo antes posible.
  • El periodo de prescripción que tiene el IRS para auditar tu declaración de impuestos no comenzará hasta que efectivamente la presentes. Por lo tanto, cuanto antes presentes tu declaración de impuestos, más pronto comenzará a correr el plazo.
  • Algunas elecciones tributarias se deben realizar antes de la fecha de vencimiento, aunque estés esperando un reembolso. Esto se aplica a un porcentaje muy pequeño de contribuyentes.

Si tienes un saldo pendiente

Si no pagaste la totalidad del impuesto que adeudas antes de la fecha límite de presentación:

  • probablemente terminarás debiendo una multa por pago tardío del 0.5% por mes o una fracción proporcional hasta que lo pagues.
  • La multa máxima por pago tardío es del 25% de la cantidad adeudada.
  • También es probable que adeudes intereses sobre la cantidad que no hayas pagado antes de la fecha límite de presentación.

Si no solicitaste una prórroga:

  • también puedes recibir una multa por presentación tardía del 5% del impuesto no pagado por mes, más los intereses.
  • La multa máxima por presentación tardía es del 25% de la cantidad adeudada.

Importante: no se aplica el periodo de prescripción

Independientemente de si te deben un reembolso o si debes impuestos, hay otro punto que hay que debes tener en cuenta: Si nunca presentas tu declaración de impuestos, no hay límite en la cantidad de años que el IRS puede retroactivamente imponer y recaudar impuestos.

¿Qué sucede si tengo una deuda con el IRS pero no puedo pagarla?

Si te encuentras en esta situación, tienes varias opciones disponibles, que incluyen:

  • pagos con tarjeta de crédito
  • acuerdos de pagos a plazos
  • ofrecimientos de conciliación

También puedes simplemente presentar tu declaración de impuestos y esperar a que el IRS te envíe una factura, pero no te sorprendas si la factura incluye intereses y multas. Por lo general, la multa por incumplimiento de pago es menor que la multa por incumplimiento de presentación, así que quizás deberías presentar la declaración aunque no puedas pagar los impuestos adeudados.

¿Puedo pagar mis impuestos con tarjeta de crédito?

Sí, puedes pagar tu factura de impuestos con crédito de varias maneras. Las tarjetas de crédito y los préstamos bancarios son opciones de pago válidas. Puedes solicitar un préstamo bancario, un préstamo hipotecario o tomar un adelanto en efectivo en una tarjeta de crédito para pagar tu factura de impuestos.

También está disponible la opción de proveedores externos, como la Corporación de Pagos Oficiales, que facilitan el uso de una tarjeta de crédito para pagar tu factura de impuestos.

    • Estas empresas cobran una comisión por servicio (de aproximadamente el 2.5% de la cantidad que se paga) por su servicio.
    • Ese cargo es adicional a los intereses y a los cargos financieros que la compañía de la tarjeta de crédito te pueda cobrar.

Nota de TurboTax:

Una extensión de tiempo para presentar tu declaración de impuestos, no es una extensión de tiempo para pagar tus impuestos. Tus impuestos aún vencen en la fecha límite. Si esperas deber dinero, debes estimar la cantidad que debes y pagarla junto con el Formulario 4868. De lo contrario, pudieras quedar a deber una multa por presentación tardía de 0.5 % del impuesto que no has pagado cada mes.

¿Puedo pagar mis impuestos en pagos a plazos?

Si debes más de lo que puedes pagar, tienes que presentar la declaración de impuestos de todos modos.

      • Aunque no adjuntes un cheque por el saldo pendiente, presentar tu declaración de impuestos te protege de la multa por presentación tardía que, de otro modo, continuaría aumentando tu deuda.
      • Adjunta un Formulario 9465 de solicitud para un plan de pagos a plazos a tu declaración de impuestos para solicitar al IRS que configure un plan de pagos a plazos mensuales para cancelar lo que adeudas.

Alrededor de 2.5 millones de contribuyentes pagan sus facturas dentro del marco de un acuerdo de este tipo, y recientemente, el IRS simplificó los requisitos para calificar.  En el pasado, antes de que el IRS aprobara un plan de pago en cuotas, la agencia requería un análisis de tus finanzas (tus activos, pasivos y flujo de efectivo, entre otros) para poder decidir cuánto podías pagar.

      • Eso ya no es un requisito en los casos donde la cantidad adeudada está por debajo de los $10,000 y el plan de pago propuesto no se prolonga por más de tres años.

Pero no te creas que es fácil aprovecharse del IRS. Sería mejor si pudieras pedir prestado el dinero para pagar la factura, en lugar de tener que acordar un plan de pago a plazos, lo que significa, efectivamente, pedirle prestado al IRS.

      • El IRS cobra una tasa de $52 para configurar un plan de pago a plazos con débito directo y $105 para los acuerdos que no se cobran con débito directo. (Para los individuos de bajos ingresos que sean elegibles, la tasa es de $43).
      • La tasa de interés del IRS para los pagos tardíos fue del 8 % en el cuarto trimestre de 2023 y puede cambiar cada tres meses.
      • También hay una multa por pago tardío de 1/4 del 1 % mensual. La tasa de interés del 8 % para 2023 más 1/4 del 1 % mensual puede sumar hasta un equivalente del 11 % anual.

¿El IRS negocia alguna vez la cantidad adeudada?

En determinadas circunstancias, el IRS está autorizado a aceptar menos que el pago completo para resolver una deuda tributaria.       1. cuando existen dudas de que el impuesto sea correcto;

      3. cuando el impuesto es correcto y podrías pagarlo, pero el pago ocasionaría una circunstancia excepcional, dificultades económicas o sería injusto y no equitativo.

Para solicitar un ofrecimiento de conciliación en el IRS, se debe completar el Formulario 656. Junto con el paquete del Formulario 656, se incluyen el Formulario 433-A (Declaración de información de cobro para asalariados y trabajadores por cuenta propia) y el Formulario 433-B (Declaración de información de cobro para empresas).

      • Es posible que tengas que completar el Formulario 433 correspondiente, y debes estar preparado para proporcionar otros documentos y explicaciones si te los solicitan.
      • Las solicitudes de ofrecimiento de transacción aceptadas permiten varias opciones, como pago total reducido y pagos mensuales programados.
      • Incumplir con un ofrecimiento de transacción aceptado puede dar lugar a que el IRS presente una demanda en tu contra y a que se restablezca la deuda tributaria original, más intereses y multas.

¿Puedo obtener una prórroga para pagar mis impuestos?

Si deseas solicitar una prórroga para el pago de impuestos, puedes presentar el Formulario 1127 de solicitud de prórroga para el pago de impuestos ante el IRS, pero los requisitos legales son estrictos:

      • El IRS debe recibir el Formulario 1127 a más tardar el día de vencimiento del impuesto.
      • Debes proporcionar una declaración completa de todos tus activos y pasivos al final del mes anterior, junto con una lista detallada del dinero que recibiste y gastaste durante los tres meses inmediatos previos al envío de la solicitud de prórroga del pago.
      • Debes probar que pagar el impuesto dentro de la fecha límite generaría dificultades excesivas; un simple inconveniente no es suficiente para calificar como una adversidad.
      • Tienes que demostrar que pagar el impuesto dentro de la fecha límite generaría una pérdida financiera sustancial y que no tienes el efectivo ni puedes reunir el dinero mediante la venta de una propiedad ni con un préstamo.

Una vez aprobadas, las prórrogas de pago generalmente se limitan a seis meses. Además, el IRS requiere alguna forma de garantía aceptable antes de otorgar una prórroga de pago. Esta garantía puede incluir bonos, avisos de gravámenes, hipotecas u otros medios, según las circunstancias individuales.
