Por ejemplo, en el año tributario 2023:

  • La tasa del 12 % aplica contribuyentes solteros con un ingreso tributable entre $11,275 y $44,775. El ingreso tributable que excede esta cantidad tributa al 22 %.
  • Si calificas para presentar tus impuestos como cabeza de familia, puedes tener un ingreso tributable entre $15,700 y $59,850 antes de sobrepasar la escala tributaria del 12 % a la escala tributaria del 22 %.
  • Por ejemplo, si tu ingreso tributable es $50,000, presentar como cabeza de familia resulta en $620 menos en impuestos federales comparado a presentar tus impuestos como soltero.

¿Qué se requiere para sostener financieramente un hogar?

El primer requisito para presentar una declaración como cabeza de familia es que tienes que haber pagado más de la mitad de los gastos que implican mantener tu hogar durante el año tributario. Esto significa que tienes que haber pagado más de la mitad del total de las facturas del hogar, lo que incluye renta o hipoteca, facturas de servicios públicos, seguro, impuestos sobre la propiedad, alimentos, reparaciones y otros gastos comunes del hogar.

  • Presentas una declaración separada
  • Pagaste más de la mitad del costo de mantener tu vivienda durante el año tributario

¿Qué es un hijo calificado?

El requisito de hijo calificado o dependiente se extiende más allá de tu propio/a hijo/a. Para ser considerado un hijo calificado, se debe cumplir con los criterios en cada una de las siguientes categorías:

  • El hijo debe ser tu hijo/a biológico/a, hijastro/a, hijo/a de crianza, hermano/a, hermanastro/a, medio hermano/a o un descendiente (hijo/a, nieto/a, bisnieto/a, etc.) de uno de estos familiares.
  • El hijo tiene que haber vivido en tu hogar por más de seis meses durante el año tributario.
  • El hijo debe ser más joven que tú.
  • Al final del año tributario, el hijo debe ser menor de 19 años si no es estudiante, o menor de 24 si es un estudiante activo a tiempo completo.
  • El hijo no puede haber pagado más de la mitad de sus gastos de vivienda durante el año tributario.

En algunos casos, es posible que puedas calificar para presentar tu declaración como cabeza de familia aun si no puedes reclamar a tu hijo/a como dependiente. Para padres separados o divorciados, si el hijo vivió en tu hogar por más de la mitad del año, puedes presentar tu declaración como cabeza de familia, incluso si el acuerdo de divorcio o separación da al otro padre el derecho a reclamar al hijo como dependiente.

¿Qué es un dependiente calificado?

Si tu dependiente no cumple los criterios para ser un hijo calificado, es posible que igualmente califiques para presentar tu declaración como cabeza de familia. Los siguientes familiares se consideran dependientes calificados para el estado civil cabeza de familia, siempre que proporciones más de la mitad de su sustento financiera y que vivan contigo durante más de la mitad del año

  • Tu hijo/a biológico/a, hijastro/a, hijo/a de crianza, hermano/a, hermanastro/a, medio hermano/a o un descendiente (hijo/a, nieto/a, bisnieto/a, etc.) de uno de estos familiares, con una discapacidad total y permanente, incluso si no cumple con los requisitos de edad para ser considerado/a un hijo calificado
  • Tu madre o padre
  • Tu padrastro, madrastra, sobrino/a, un/a hermano/a de uno de tus padres, o tu yerno, nuera, suegro/a o cuñado/a

Incluso si tu padre o madre no vivieron contigo por más de la mitad del año tributario, es posible que puedas calificar para presentar tu declaración como Cabeza de Familia. Si pagaste más de la mitad de los gastos de la vivienda principal de tu padre o madre durante todo el año tributario y eres elegible para reclamarlos como dependientes, entonces podrás presentar tu declaración como cabeza de familia.

¿Cómo se compara el estado cabeza de familia a otros estados civiles para efectos de presentación?
