El Formulario W-9 del IRS (Servicio de Impuestos Internos) se suele usar para proporcionar información necesaria a una persona o empresa que hará pagos a otra persona o empresa. ¿Qué es el Formulario W-9 del IRS?

El Formulario W-9 es un formulario muy utilizado del IRS. Si trabajas para una empresa que te paga como contratista independiente, freelancer o trabajador por encargo (en otras palabras, trabajas por cuenta propia) o si recibirás ingresos tales como intereses o dividendos, una empresa podría pedirte que llenes y envíes un Formulario W-9 para que pueda preparar un Formulario 1099 con precisión, reportar los pagos que te hace al final del año y saber si te corresponde o no la retención de impuesto adicional. Y si contratas trabajadores independientes.

¿Quién pide que se complete un Formulario W-9?

La persona o empresa que te paga es responsable de solicitarte un Formulario W-9. Sin embargo, el solicitante no tiene la obligación de presentar el Formulario W-9 ante el IRS. Esa persona guarda el formulario y usa esa información para preparar otras declaraciones, como los Formularios 1099 y los Formularios 1098, así como para determinar si es necesario retener impuestos federales de los pagos que recibas.

¿Quién necesita completar el Formulario W-9?

Por lo general, enviarás un Formulario W-9 si trabajas para una empresa y es posible que tengas que reportar información al IRS, como el recibir pagos por los servicios que prestas como contratista independiente, el pago de intereses sobre tu hipoteca o incluso la contribución de dinero a tu cuenta IRA.

La persona o empresa con la que trabajas usa el Formulario W-9 para reunir algunos de tus datos personales, de los cuales el más importante es tu número de identificación del contribuyente (TIN, por sus siglas en inglés).

¿Cuándo deberías solicitar un Formulario W-9?

Cuando comienzas a trabajar con un contratista o trabajador por cuenta propia a quien vas a pagarle, deberías pedirle que complete un Formulario W-9 antes de iniciar cualquier actividad. No hacerlo podría generar problemas después de iniciadas las tareas.

Por lo tanto, antes de empezar a trabajar con una persona o empresa, asegúrate de pedir un Formulario W-9 si aún no te lo dieron. Si no lo haces, es posible que tengas que pagar retenciones de impuestos sobre el dinero que les pagues.

¿Qué es la retención de impuesto adicional?

La retención de impuesto adicional es dinero que se envía al IRS de los pagos de ingresos que, de otro modo, no estarían sujetos a ninguna retención. Es posible que los pagadores tengan que retener impuestos para asegurarse de que el IRS reciba los impuestos sobre ingresos que se le adeudan.

Los contribuyentes podrían estar sujetos a la retención adicional si no proporcionan un número de identificación del contribuyente (TIN) correcto o si el IRS cree que adeudan dinero y no pueden reunirlo de ninguna otra manera. Además, las personas o empresas pueden quedar sujetas a la retención adicional por no reportar ingresos por intereses, por dividendos o por dividendos para patrocinadores.

En concreto, podrías estar sujeto a la retención adicional y el pagador debe retener una tasa fija del 24 % para 2022 en los siguientes casos:

  • No proporcionas tu TIN o proporcionas uno incorrecto.
  • El IRS notifica al pagador que retenga impuestos porque tienes antecedentes de haber reportado ingresos de menos en tu declaración de impuestos (normalmente, el IRS solo hará esto después de haberte enviado por correo postal cuatro notificaciones durante un periodo de al menos 120 días).
  • No certificas que no estás sujeto a la retención adicional.

Por lo general, puedes evitar la retención adicional brindando la información correcta cuando se te pida y pagando la cantidad de impuestos adecuada cada año. Si recibes un Formulario 1099 indicando que se te han retenido impuestos a través de la retención adicional, asegúrate de reportarlo como retención de impuesto federal sobre los ingresos en tu declaración de impuestos sobre los ingresos.

Diferencias entre el Formulario W-9 y el Formulario W-4

Al comenzar a trabajar como empleado o contratista independiente, es esperable que debas llenar algunos documentos para proporcionar tu información personal.

Si eres contratista independiente, proveedor, trabajador por cuenta propia o una persona que recibe una compensación para personas que no son empleados, por lo general, no eres empleado de la persona o empresa que te contrata. Si no trabajas como empleado, normalmente reportarás tus ingresos en un Formulario 1099-NEC y tendrás que preparar un Formulario W-9.

El Formulario W-9 incluirá tu información personal e indicará si estás sujeto a la retención de impuesto adicional. A menos que estés sujeto a dicha retención, la persona o empresa en cuestión no retendrá impuestos en tu nombre.

Por el contrario, si eres empleado, completarás un Formulario W-4 para que tu empleador sepa cuánto dinero deseas que retenga de tu cheque salarial en concepto de impuestos federales sobre los ingresos.

¿Cómo completar el Formulario W-9?

Puedes descargar el Formulario W-9 del sitio web del IRS. Para completar el Formulario W-9, tendrás que proporcionar información en las siguientes líneas y partes:

Línea 1: Nombre

Si envías el Formulario W-9 como persona física, debes ingresar el nombre que aparece en tu declaración de impuestos. Si has cambiado tu apellido sin informarlo a la Administración del Seguro Social (SSA, por sus siglas en inglés), ingresa tu nombre, el apellido que aparece en tu tarjeta del Seguro Social y tu nuevo apellido.

Si has pedido un Número de Identificación Personal del Contribuyente (ITIN), ingresa tu nombre tal cual lo ingresaste en la línea 1a de la solicitud (Formulario W-7). Esto también debería coincidir con el nombre que ingresaste en el Formulario 1040.

Si envías el formulario como empresario individual o compañía de responsabilidad limitada (LLC) de un solo miembro, ingresa tu nombre como aparece en tu Formulario 1040/1040A/1040EZ. Puedes ingresar tu negocio, rubro o tipo de operación (DBA, por sus siglas en inglés) en la línea 2.

Si completas el formulario como sociedad colectiva, LLC de varios miembros, sociedad anónima de tipo C o sociedad anónima de tipo S, ingresa el nombre en la línea 1 como se muestra en la declaración de impuestos correspondiente, e ingresa el negocio, rubro o tipo de operación en la línea 2.

Línea 2: Nombre comercial

Si completas tu Formulario W-9 como empresa, usa esta línea para proporcionar la información.

Línea 3: Clasificación tributaria federal

Según el caso, en la línea 3, selecciona la clasificación tributaria federal más adecuada para el nombre ingresado en la línea 1. Marca solo una casilla en la línea 3 del Formulario W-9.

Varios tipos de personas y empresas pueden llenar el Formulario W-9. Estas son las opciones correspondientes a las casillas que deberías marcar en la línea 3.

Línea 4: Exenciones

Si completas el Formulario W-9 como persona física, no debes preocuparte por llenar esta sección.

Algunas empresas y organizaciones están exentas de la retención adicional en determinados casos y tendrán que llenar esta línea. Si alguna de estas opciones se aplica a tu situación, deberás proporcionar un código de números o letras, según las instrucciones, que represente los motivos de esta declaración. En la mayoría de los casos, las sociedades anónimas y las empresas quedarán exentas de la retención de impuesto adicional.

La Ley de Cumplimiento Fiscal de Cuentas Extranjeras (FATCA, por sus siglas en inglés) aparece en la segunda entrada de la línea Exenciones. A las instituciones financieras extranjeras se les suele exigir que reporten los pagos hechos a clientes que sean personas de los Estados Unidos, y que retengan impuestos de dichos pagos. Sin embargo, ciertos beneficiarios están exentos de esta disposición y tendrán que ingresar el código aplicable que se indica en las instrucciones del Formulario W-9 para reafirmar la exención.

Líneas 5 y 6: Dirección, ciudad, estado y código postal

Esta es la dirección a la que la persona o empresa te enviará por correo postal tu Formulario 1099. La dirección, ciudad, estado y código postal se ingresarán en las líneas 5 y 6.

Línea 7: Número(s) de cuenta

Usa la línea 7 si tienes que proporcionarle a la persona o empresa que te paga la información de la cuenta, como una cuenta bancaria o de corretaje, asociada a la solicitud del Formulario W-9.

Parte I: TIN

En esta sección, proporcionarás tu número de identificación del contribuyente (TIN). Si eres una persona física o LLC de un solo miembro, este será, por lo general, tu número de Seguro Social. También puede incluir tu número de identificación del empleador (EIN) si eres una LLC de varios miembros clasificada como sociedad colectiva, sociedad anónima de tipo C o sociedad anónima de tipo S.

Si operas como empresario individual, puedes incluir cualquiera de esos números.

En el caso de que vivas en los Estados Unidos como extranjero residente y, por tanto, no seas elegible para tener un número de Seguro Social, puedes usar tu ITIN (Número de Identificación Personal del Contribuyente) del IRS.

Parte II: Certificación

Firma y fecha el formulario en este campo, y declara que la información proporcionada es precisa a tu leal saber y entender. Tendrás que tachar la partida 2 de la certificación si estás sujeto a la retención de impuesto adicional por no haber reportado todos los intereses y dividendos en tu declaración de impuestos.

La certificación afirma que eres un ciudadano estadounidense, otra persona de los Estados Unidos o un extranjero residente. Si preparas tu Formulario W-9 en calidad de cuenta conjunta, solo debe firmar el formulario la persona cuyo TIN aparece en la Parte I.

¿Para qué se usa el Formulario W-9?
