Pagos entre pares (Peer-to-Peer)

Tanto las personas como las pequeñas empresas adoptaron las aplicaciones de pago entre pares (P2P) para hacer prácticas transferencias de dinero desde teléfonos móviles. Ya sea que dividas la cuenta del restaurante con tus amigos o hagas cobros para tu restaurante o pequeña empresa, es probable que estés usando PayPal y Venmo más de lo que esperabas hace apenas unos años.

Estos métodos de pago son tan prácticos y fáciles de usar que todo el mundo los adopta, sin embargo, ¿hay impuestos de PayPal o Venmo que debas conocer?

Uso de plataformas P2P para negocios

En un principio, las plataformas como PayPal y Stripe se diseñaron como soluciones de pago en línea para empresas. PayPal, por ejemplo, brinda a los usuarios la opción de configurar cuentas comerciales y personales. Más adelante, apareció Venmo (que es de PayPal), pero inicialmente no se podía usar para fines comerciales. Eso cambió en 2016, cuando Venmo comenzó a permitir que algunos negocios aceptaran Venmo como método de pago.

Consecuencias tributarias del uso de aplicaciones P2P

Si usas una de esas aplicaciones para tu negocio, estas son algunas de las consecuencias tributarias de PayPal y Venmo que debes tener en cuenta.

Reportar los ingresos

Las personas que envían dinero de un lado a otro para pagar su parte de la cena no tienen que preocuparse por reportar esos pagos en sus declaraciones de impuestos. Sin embargo, desde el momento en el que comienzas a aceptar pagos comerciales en una plataforma P2P, eres responsable de reportar esas ganancias. Las plataformas de pago P2P, como PayPal, Venmo y Stripe, entre otras, tienen la obligación de proporcionar al IRS (Servicio de Impuestos Internos) información sobre los clientes que reciben pagos por la venta de bienes y servicios a través de estas.

Sin embargo, el límite para reportar esos pagos es alto.  Las plataformas de pagos a terceros tienen la obligación de reportar los pagos brutos a vendedores que reciben:

  • más de $20,000 en volumen de pagos bruto Y
  • más de 200 pagos independientes en un año calendario.

No hay una cantidad límite para transacciones de tarjeta de crédito como cuando pasas o insertas la tarjeta.

El IRS planificó implementar cambios a los requisitos para reportar el Formulario 1099-K en el año tributario 2023. Sin embargo, el IRS recientemente aplazó la implementación del nuevo umbral de $600 para reportar transacciones de procesadores de pagos a terceros por bienes y servicios como Venmo y PayPal hasta, habiendo revertido el año tributario 2023 de vuelta al umbral mayor anterior del Formulario 1099-K del (sobre $20,000 en pagos y más de 200 transacciones). Si no recibes un 1099-K, el IRS aún espera que reportes todo tu ingreso, sin importar la cantidad.

Si superas ese límite, la plataforma te enviará un Formulario 1099-K correspondiente a ese año a ti y al IRS a principios del año siguiente. Sin embargo, incluso si no recibes un Formulario 1099-K, igual tienes la obligación de reportar los ingresos sujetos a impuestos que recibas a través de esas plataformas en tu declaración de impuestos sobre el ingreso.

Nota de TurboTax:

Si pagas gastos utilizando plataformas P2P, debes guardar tus facturas y recibos para documentar tus gastos. Una transacción P2P que indique cuando se llevó a cabo, por si sola, usualmente no provee suficiente información para respaldar un gasto de negocio.

 

Diligencia debida

Si recibes parte o, incluso, la totalidad de los ingresos de tu negocio a través de una plataforma de pago P2P, lo mejor es que crees una cuenta de empresa. De lo contrario, se te mezclarán las transacciones comerciales y personales, y te será más difícil separar los pagos en personales y comerciales.

Lleva un registro detallado de los ingresos totales que recibiste de todas las fuentes durante el año para poder hacer un reporte de impuestos exacto. QuickBooks Self-Employed es una buena opción que se integra con todas las principales plataformas de pago móvil.

If you have a simple Form 1040 return only (no forms or schedules except as needed to claim the Earned Income Tax Credit, Child Tax Credit or student loan interest), you can file for free yourself with TurboTax Free Edition, or you can file with TurboTax Live Assisted Basic at the listed price. Examples of situations included in a simple Form 1040 return (assuming no added tax complexity):
