¿Soy elegible para la deducción por el uso comercial del hogar?

En términos generales, a fin de calificar para la deducción por el uso comercial del hogar, debes cumplir uno de los siguientes criterios:

  • Uso exclusivo y regular: debes usar una porción de tu casa, apartamento, condominio, casa móvil , bote o estructura similar para tu negocio de manera regular. Esto también incluye estructuras en tu propiedad, como un estudio, granero, invernadero o garaje separado. Si soy un empleado que trabaja desde casa, ¿califico para la deducción por el uso comercial del hogar?

El uso exclusivo no significa que:

  • Tengas prohibido realizar una llamada personal desde la oficina;
  • Tengas que salir con urgencia si un familiar necesita algo de tu tiempo.

Aunque los auditores individuales del IRS pueden ser más o menos estrictos sobre este punto, algunos asesores dicen que cumples con el espíritu del requisito de uso exclusivo siempre que las actividades personales no invadan la oficina en el hogar por más tiempo del que se permitirían en un edificio de oficinas. La oficina también puede ser una parte de una habitación, y puedes demostrar que esas actividades personales no se realizan en la sección de uso comercial.

¿Qué significa "uso regular"?

No hay una definición específica de lo que constituye un uso regular. Es claro que, si usas una habitación vacía solo en ocasiones y su uso para tu negocio es incidental, no cumples este requisito. Sin embargo, si trabajas en la oficina en casa durante unas pocas horas del día, tal vez lo cumplas. Este requisito se aplica a los hechos y circunstancias de cada caso que cuestiona el IRS.

¿Qué significa "lugar principal de negocios"?

Además de cumplir con los requisitos de uso regular y uso exclusivo, tu oficina en casa debe ser la ubicación principal de ese negocio o un lugar que uses para reuniones regulares con clientes.

Si tu oficina en casa se encuentra en una estructura separada e independiente (como un garaje separado convertido en oficina), no tienes que cumplir con el requisito de lugar principal de negocios ni con el de trato con clientes. Siempre que cumplas los requisitos de uso regular y de uso exclusivo, puedes calificar para la deducción por el uso comercial del hogar.

¿Qué sucede si tu negocio tiene solo una oficina en el hogar, pero realizas la mayor parte del trabajo en otro lugar?

Recuerda que el requisito exige que tu oficina en casa sea tu lugar principal de negocios, no tu lugar de trabajo principal. Siempre y cuando uses la oficina en el hogar para realizar tus tareas administrativas y no hagas un uso sustancial de cualquier otra ubicación fija para llevar a cabo esas tareas, puedes cumplir con este requisito.

Si eres empleado de otra empresa, pero también tienes tu propio negocio de tiempo parcial con sede en tu casa, puedes cumplir este requisito incluso si pasas mucho más tiempo en la oficina en la que trabajas como empleado.

Esta regla facilita mucho más la reclamación de la deducción por uso comercial del hogar para las personas que realizan la mayoría de las actividades que les generan ingresos en otro lugar (como vendedores o comerciantes).

¿Qué califica como negocio?

Al igual que ocurre con el requisito de uso regular, que tu actividad califique como negocio depende de los hechos y las circunstancias. Cuanto más sustanciales sean las actividades (en términos de tiempo y esfuerzo invertidos, y de ingresos obtenidos), más probable será que cumplas el requisito.

Ganar dinero por tus esfuerzos es un requisito previo, pero, a los fines de este beneficio tributario, la ganancia por sí sola no es necesariamente suficiente. Por ejemplo: si usas tu sala de estar únicamente para ocuparte de tu cartera de inversiones personales, no puedes reclamar la deducción por el uso comercial del hogar, ya que tus actividades como inversionista no califican como negocio.

Los contribuyentes que usan una oficina en el hogar exclusivamente para administrar propiedades de alquiler podrían calificar para la condición tributaria de uso comercial del hogar, pero como administradores de propiedades, no como inversionistas.

¿Qué sucede si opero un establecimiento de cuidado de menores o una instalación de almacenamiento?

El requisito de uso exclusivo no se aplica si usas parte de tu hogar para lo siguiente:

  • Proporcionar servicios de cuidado de menores, adultos mayores o personas discapacitadas. Por ejemplo: si cuidas niños en tu hogar entre las 7:00 a. m. y las 6:00 p. m. cada día, puedes utilizar esa parte de la casa para actividades personales durante el resto del tiempo y, aun así, reclamar deducciones comerciales. A fin de calificar para el beneficio tributario, tu negocio de cuidado en el hogar debe cumplir con los requisitos de licencias estatales y locales.
  • Almacenar muestras o inventarios de productos que vendes en tu negocio. Supongamos que tu negocio desde casa es vender al por menor productos de limpieza para el hogar y que usas regularmente la mitad de tu sótano para almacenar el inventario. Usar de forma ocasional esa parte del sótano para almacenar artículos personales no cancelaría tu deducción por el uso comercial del hogar. A fin de calificar para esta excepción, tu vivienda debe ser la ubicación principal de tu negocio.

¿Cómo calculo la deducción tributaria por el uso comercial del hogar?

La deducción por el uso comercial de tu hogar se basa en el porcentaje de la vivienda que usas para tu negocio o en un cálculo simplificado de pies cuadrados.

La forma más exacta de calcular el porcentaje de uso comercial de tu hogar es medir los pies cuadrados dedicados a tu oficina en casa como un porcentaje de la superficie total de tu vivienda. Por ejemplo: si la oficina mide 150 pies cuadrados y la superficie total de la casa es de 1,200 pies cuadrados, el porcentaje de uso comercial sería del 12.5 %.

Es aceptable un cálculo más sencillo si todas las habitaciones de tu vivienda tienen aproximadamente el mismo tamaño. En ese caso, para averiguar el porcentaje de uso comercial, divide el número de habitaciones usadas en tu negocio por el total de habitaciones que tiene la casa.

Se aplican reglas especiales si calificas para la deducción por el uso comercial del hogar por la excepción del requisito de uso exclusivo en el caso de actividades de guardería.

  • El porcentaje de uso comercial debe reducirse porque el espacio está disponible para uso personal parte del tiempo.
  • Para hacerlo, compara el número de horas que funciona el negocio de cuidado de menores, incluido el tiempo de preparación y limpieza, con el número de horas del año (8,760).

Supongamos que usas el 40 % de tu casa para un negocio de guardería que funciona 12 horas al día, cinco días a la semana, durante 50 semanas del año.

  • 12 horas x 5 días x 50 semanas = 3,000 horas por año.
  • 3,000 horas ÷ 8,760 horas totales del año = 0.34 (34 %) de horas disponibles.
  • 34 % de horas disponibles x 40 % de la casa usado para el negocio = 13.6 % de deducción comercial.

¿Qué es el método de pies cuadrados simplificado?

A partir de las declaraciones de impuestos de 2013, el IRS comenzó a ofrecer una opción simplificada para reclamar la deducción. Este nuevo método usa una tasa preestablecida multiplicada por los pies cuadrados permitidos usados en el hogar.

  • Para 2022, la tasa preestablecida es de $5 por pie cuadrado hasta un máximo de 300 pies cuadrados.
  • Por ejemplo: si la oficina mide 150 pies cuadrados, la deducción sería de $750 (150 x $5).
  • De todos modos, el espacio se debe dedicar a actividades comerciales.
