    El Crédito Tributario por Hijos (CTC, por sus siglas en inglés) es un crédito parcialmente reembolsable que proporciona alivio financiero a los padres y madres con hijos menores de 17 años que cumplan los requisitos.     ¿Qué es el Crédito Tributario por Hijos?

    Desde pañales y fórmula cuando son bebés hasta aparatos ortopédicos y seguro de automóvil cuando son adolescentes, los padres y las madres desembolsan una gran cantidad de dinero para sus hijos cada año. Afortunadamente, el Tío Sam ofrece un beneficio tributario valioso que puede ayudar a compensar algunos de estos gastos: el Crédito Tributario por Hijos.

    El Crédito Tributario por Hijos es un crédito tributario federal sobre el ingreso disponible para determinadas familias con hijos. Para el año tributario 2025, tiene un valor de hasta $2,200 por cada hijo/a que califica. Sin embargo, esa cantidad se puede reducir, y puede llegar a $0, si tu ingreso bruto ajustado modificado para el año es demasiado alto. El Crédito Tributario por Hijos de 2024 es de $2,000 por hijo/a que califica. 

    El crédito también es parcialmente reembolsable. Básicamente, esto significa que se puede generar un reembolso de impuestos si la cantidad del crédito es mayor que el impuesto que debes antes de aplicar el crédito. Sin embargo, la cantidad reembolsable, conocida como Crédito Tributario Adicional por Hijos, puede ser limitada.

    Si tienes hijos, sin duda será conveniente reclamar el Crédito Tributario por Hijos en las declaraciones de impuestos de 2024 y 2025, si puedes. Ahora bien, para aprovechar al máximo este valioso beneficio tributario, tendrás que familiarizarte con los requisitos de elegibilidad, la forma de calcular el crédito, la forma de reclamarlo y otras cosas.     ¿Quién puede reclamar el Crédito Tributario por Hijos?

    Lo primero de todo, para poder reclamar el Crédito Tributario por Hijos, debes tener al menos un/a “hijo/a calificado/a” (lo explicamos a continuación).

    Además, debes tener (o tu cónyuge, si presentan una declaración de forma conjunta) un número de Seguro Social o un Número de Identificación Personal del Contribuyente (ITIN, por sus siglas en inglés) emitido a más tardar en la fecha de vencimiento de tu declaración de impuestos federales sobre los ingresos (incluidas las prórrogas de presentación de impuestos). Puedes cumplir con este requisito si solicitas un ITIN antes de la fecha límite y el IRS realmente te emite uno.

    Finalmente, por lo general, no puedes reclamar el Crédito Tributario por Hijos si a ti se te puede reclamar (o a tu cónyuge, si presentan una declaración de forma conjunta) como dependiente en la declaración de impuestos de otra persona. Sin embargo, puedes reclamar el crédito si la persona que podría reclamarte como dependiente en su declaración de impuestos:

    • no tiene la obligación de presentar una declaración y, en realidad, no la presenta;
    • presenta una declaración solo para obtener un reembolso por los impuestos sobre el ingreso retenidos o los impuestos estimados pagados para el año tributario, y no te reclama como dependiente.

    Si realizas la presentación a través de TurboTax, tendrás que responder preguntas sencillas para determinar si cumples los requisitos para calificar para este crédito tributario cuando completes la declaración de impuestos.

    ¿Qué se entiende por “hijo/a calificado/a” para los fines del Crédito Tributario por Hijos?

    Como se indicó anteriormente, solo puedes reclamar el Crédito Tributario por Hijos si tienes un/a “hijo/a calificado/a”. Para calificar, por lo general, el menor tiene que cumplir estos ocho requisitos:

    1. Requisito de edad: Tu hijo/a debe tener 16 años o menos al final del año tributario a fin de calificar para el Crédito Tributario por Hijos. Dado que lo que importa es la edad que tenía el menor el 31 de diciembre, un/a hijo/a que cumple 17 años o más en cualquier momento durante el año no es un/a hijo/a calificado/a para los fines del crédito.

    Por otro lado, el menor que haya nacido (o sido adoptado) en cualquier momento durante el año tributario, incluso si es a las 11:59 p. m. del 31 de diciembre, puede ser un/a hijo/a calificado/a para el año si se cumplen todas las demás condiciones.

    1. Requisito de parentesco: Por lo general, el menor tiene que ser tú:
    • Hijo/a biológico/a
    • Hijastro/a
    • Hijo/a adoptado/a
    • Hijo/a de crianza
    • Hermano/a (incluido un hermanastro/a, medio hermano/a)

    Sin embargo, un/a hijo/a calificado/a también puede ser descendiente de uno de los anteriores (como un/a nieto/a o sobrino/a).

    1. Requisito de dependencia: El menor debe ser reclamado/a como dependiente en tu declaración de impuestos para que sea un/a hijo/a calificado/a. El simple hecho de poder reclamar al menor como dependiente no es suficiente; debes hacerlo realmente.

    Si los padres del menor están divorciados o separados, el progenitor que tiene la custodia suele ser quien lo reclama como dependiente. Sin embargo, el progenitor que no tiene la custodia puede reclamar al menor como dependiente en ciertos casos (hay más información a continuación).

    1. Requisito de sustento financiero: Un/a hijo/a calificado/a no puede proporcionar más de la mitad de su propio sustento financiero para el año tributario.

    Los pagos de Asistencia Temporal para Familias Necesitadas (TANF, por sus siglas en inglés) o asistencia similar utilizados para mantener a un menor no cuentan al determinar si el menor proporcionó más de la mitad de su propio sustento financiero. Lo mismo ocurre con el dinero que recibes del Gobierno o de una agencia de colocación para el sustento financiero de un/a hijo/a de crianza.

    Por otro lado, si el menor recibe beneficios de Seguro Social y los usa para su propio sustento financiero, los beneficios se tratan como si los proporcionara el menor.

    1. Requisito de residencia: Por lo general, el menor tiene que vivir contigo durante más de la mitad del año tributario para ser un/a hijo/a calificado/a a los fines del Crédito Tributario por Hijos. Sin embargo, hay algunas excepciones a este requisito que se aplican en determinadas situaciones.

    Por ejemplo, las ausencias temporales, como la escuela, las vacaciones, la atención médica o la detención en un centro juvenil, cuentan como tiempo que vivió contigo.

    Si el menor nace o muere durante el año tributario, el requisito de residencia se cumple si el menor vive en tu hogar durante más de la mitad del tiempo que vivió ese año. Si el menor tuvo que permanecer en el hospital después del nacimiento, el tiempo que pasó en el hospital también se considera tiempo que vivió en tu hogar.

    Del mismo modo, el/la hijo/a adoptivo/a o de crianza cumple el requisito de residencia si es adoptado/a o está bajo tu cargo durante el año tributario, y vivió en tu hogar durante más de la mitad del tiempo desde que fue adoptado/a o está bajo tu cargo.

    También se puede aplicar una excepción al requisito de residencia si el menor es secuestrado por alguien que no es un familiar.

    Además, cuando los padres del menor están divorciados o separados, es posible que haya reglas especiales que permitan al padre que no tiene la custodia reclamar el Crédito Tributario por Hijos en ciertas situaciones (estas reglas se analizan a continuación).

    1. Requisito de declaración conjunta: Por lo general, un hijo/a que está casado/a y presenta una declaración de forma conjunta no es un/a hijo/a calificado/a. Sin embargo, el menor puede calificar si presenta una declaración de forma conjunta si solo la presenta para reclamar un reembolso por impuestos retenidos o pagos de impuestos estimados.
    2. Requisito de ciudadanía: Por lo general, el menor tiene que ser ciudadano de los EE. UU., nacional de los EE. UU. o residente extranjero de los EE. UU. para ser un/a hijo/a calificado/a a los fines del Crédito Tributario por Hijos. No obstante, si eres ciudadano/a de los EE. UU. o nacional de los EE. UU. y tu hijo/a adoptivo/a vivió contigo todo el año como miembro de tu hogar, se considera ciudadano/a estadounidense.

    Según el IRS, un nacional de los EE. UU. es alguien que no es ciudadano de los EE. UU., pero debe lealtad a los EE. UU. Incluye a los habitantes de Samoa Americana y de las Islas Marianas del Norte que optaron por convertirse en nacionales de los EE. UU. en lugar de en ciudadanos de los EE. UU.

    Por lo general, una persona extranjera residente de los EE. UU. es alguien que tiene una tarjeta verde o que ha estado físicamente presente en los EE. UU. durante un determinado período de tiempo.

    El proyecto de ley One Big Beautiful Bill cambió algunos de los requisitos y las cantidades del Crédito Tributario por Hijos para 2025 y años posteriores. El proyecto de ley agrega un octavo requisito a los siete anteriores:

    1. Requisito de número de Seguro Social elegible para trabajar: la persona que reclama el crédito (al menos una persona si presenta una declaración de impuestos de forma conjunta) y el menor deben tener un número de Seguro Social que los haga elegibles para trabajar en los Estados Unidos.

    Además de agregar el octavo requisito, el proyecto de ley One Big Beautiful Bill aumentó el crédito de $2,000 a $2,200 para 2025. El crédito se ajusta por inflación para los años posteriores a 2025.

    Si el menor falleció antes de recibir un número de Seguro Social, puedes reclamar el Crédito Tributario por Hijos para el menor. Sin embargo, tendrás que proporcionar al IRS una copia del certificado de nacimiento o defunción del menor, o de los registros hospitalarios para demostrar que nació vivo.

    ¿A qué cantidad asciende el Crédito Tributario por Hijos?

    Para calcular tu Crédito Tributario por Hijos, primero determina tu cantidad base multiplicando la cantidad de hijos calificados que tienes por $2,200 para 2025, y $2,000 para 2024. Por ejemplo, si tienes tres hijos calificados en 2025, tu cantidad base es de $6,600 ($3 x $2,200 = $6,600).

    El siguiente paso es determinar tu ingreso bruto ajustado modificado (MAGI, por sus siglas en inglés). Para los fines del Crédito Tributario por Hijos, tu MAGI es igual al ingreso bruto ajustado (AGI, por sus siglas en inglés) reportado en tu declaración de impuestos, más cualquier cantidad reclamada como:

    • Exclusión de ingreso devengado en el extranjero
    • Deducción o exclusión de vivienda en el extranjero
    • Exclusión de ingreso de Puerto Rico o Samoa Americana

    Si tu MAGI es de $200,000 o menos ($400,000 o menos para contribuyentes que declaran en conjunto), no tienes que hacer nada más. Tu crédito es igual a la cantidad base ($2,200 por hijo/a calificado/a para 2025).

    Sin embargo, si tu MAGI supera el límite de $200,000 (o $400,000), tienes que reducir la cantidad base en $50 por cada $1,000 que tu MAGI supere el límite. Si tu MAGI supera el límite por una cantidad que no sea un múltiplo de $1,000, redondea hacia arriba a los $1,000 más cercanos. Por ejemplo, si la cantidad en exceso es de $2,400, redondea a $3,000 para calcular la reducción. Según la cantidad de hijos calificados que tengas, este requisito de eliminación gradual podría reducir tu crédito a $0. 

    Para mostrar cómo funciona la eliminación gradual del crédito, supongamos que tú y tu cónyuge tienen cuatro hijos calificados, presentan una declaración de forma conjunta y su MAGI es de $412,500. La cantidad base para cuatro hijos calificados es de $8,800 (4 x $2,200 = $8,800). Sin embargo, su MAGI está $12,500 por encima del límite de eliminación gradual para contribuyentes que declaran en conjunto ($412,500 - $400,000 = $12,500). Dado que la cantidad en exceso no es un múltiplo de $1,000, redondea la cantidad a $13,000. En este caso, a la cantidad base de $8,800 se le deben restar $650 ($50 x 13 = $650), lo que te deja un Crédito Tributario por Hijos total de $8,150.

    ¿Se puede reclamar el Crédito Tributario Adicional por Hijos?

    Como se indicó anteriormente, hay una parte del Crédito Tributario por Hijos que es reembolsable. El IRS llama a esa parte reembolsable el Crédito Tributario Adicional por Hijos. Según cual sea tu situación tributaria, el Crédito Tributario Adicional por Hijos puede generar un reembolso de impuestos (o aumentar el reembolso), mientras que la parte no reembolsable del Crédito Tributario por Hijos puede, en el mejor de los casos, reducir tu factura de impuestos a $0.

    Sin embargo, el Crédito Tributario Adicional por Hijos tiene algunos límites y restricciones. Por ejemplo:

    • Solo puedes reclamar el Crédito Tributario Adicional por Hijos si el total del Crédito Tributario por Hijos (calculado siguiendo las instrucciones anteriores) es mayor que tu responsabilidad tributaria antes del crédito.
    • El Crédito Tributario Adicional por Hijos tiene un tope de $1,700 por hijo/a calificado/a para los años tributarios 2024 y 2025. Por ejemplo, si tienes dos hijos que califican, la porción reembolsable del Crédito Tributario por Hijos no puede superar los $3,400 (2 x $1,700 = $3,400) para 2025.
    • Necesitas al menos $2,500 de ingresos del trabajo en 2025 para el año tributario a fin de reclamar el Crédito Tributario Adicional por Hijos. Por lo general, el ingreso del trabajo incluye sueldos, salarios, propinas, ganancias del trabajo por cuenta propia y otras compensaciones recibidas por el trabajo.
    • Habitualmente, el Crédito Tributario Adicional por Hijos no puede ser superior al 15 % de tu ingreso del trabajo por encima de $2,500. Por ejemplo, si tienes $50,000 de ingreso del trabajo, la porción reembolsable del Crédito Tributario por Hijos no puede superar los $7,125 (($50,000 - $2,500) x 0.15 = $7,125). Sin embargo, este límite puede aumentar para ciertas personas con tres o más hijos calificados.
    • No puedes reclamar el Crédito Tributario Adicional por Hijos si presentas el Formulario 2555, que se usa para reclamar la exclusión de ingreso devengado en el extranjero, la deducción por vivienda en el extranjero y la exclusión por vivienda en el extranjero.

    Nota de TurboTax:

    Si presentas tu declaración de impuestos anticipadamente y reclamas el Crédito Tributario Adicional por Hijos, el IRS tiene la obligación de retener tu reembolso de impuestos (si corresponde) hasta al menos mediados de febrero.

    ¿Quién puede reclamar el Crédito Tributario por Hijos si los padres están divorciados o separados?

    Cuando los padres de un/a hijo/a calificado/a están divorciados o separados, el progenitor que tiene la custodia suele reclamar el Crédito Tributario por Hijos. En la mayoría de los casos, el progenitor que tiene la custodia es la persona con quien el menor vivió la mayoría de las noches durante el año tributario. El progenitor que no tiene la custodia es el otro padre o madre.

    Sin embargo, bajo ciertas condiciones, el progenitor que no tiene la custodia puede reclamar el Crédito Tributario por Hijos. El primer requisito es que los padres:

    • estén divorciados o separados legalmente en virtud de una sentencia de divorcio o manutención por separación;
    • están separados en virtud de un acuerdo de separación por escrito;
    • hayan vivido separados en todo momento durante los últimos seis meses del año tributario (independientemente de que estén o hayan estado casados).

    Además, los padres tienen que haber aportado más de la mitad del sustento financiero del menor durante el año tributario. El sustento financiero proporcionado por el cónyuge de uno de los padres se considera proporcionado por el padre o la madre.

    Además, el menor tiene que haber estado bajo la custodia de uno o ambos padres durante más de la mitad del año tributario.

    Por último, el progenitor que tiene la custodia, por lo general, debe firmar el Formulario 8332 (o una declaración similar) indicando que no reclamará al menor como dependiente durante el año tributario. El progenitor que no tiene la custodia también tiene que incluir una copia del formulario o declaración junto con su declaración de impuestos. Si la sentencia de divorcio o el acuerdo de separación entró en vigor antes de 2009, es posible que el progenitor que no tiene la custodia pueda incluir ciertas páginas de la sentencia o el acuerdo en lugar del Formulario 8332.

    ¿Qué ocurre si un/a hijo/a es un “hijo/a calificado/a” de más de una persona?

    ¿Qué sucede si los padres de un menor nunca estuvieron casados y todos viven juntos en la misma casa? O supongamos que un menor vive con uno de sus padres y un abuelo. En estos casos, más de una persona podría reclamar al hijo o a la hija como “hijo/a calificado/a” para los fines del Crédito Tributario por Hijos.

    Sin embargo, el Crédito Tributario por Hijos por un hijo/a soltero/a solo se puede reclamar en una declaración de impuestos por año. Por lo tanto, cuando un hijo/a puede ser un hijo/a calificado/a de dos o más personas, el IRS usa las siguientes reglas de desempate para determinar qué persona elegible puede reclamar el crédito por el/la hijo/a:

    • Si solo una persona elegible es el progenitor del menor, ese progenitor puede reclamar el crédito.
    • Si los padres presentan una declaración en conjunto, ambos pueden reclamar el crédito en esa declaración.
    • Si los padres presentan declaraciones por separado, el progenitor con quien el/la hijo/a vivió más tiempo durante el año tributario puede reclamar el crédito.
    • Si los padres presentan declaraciones por separado y el/la hijo/a vivió con ambos durante la misma cantidad de tiempo durante el año tributario, el progenitor con el AGI más alto para el año puede reclamar el crédito.
    • Si ninguno de los padres puede reclamar al hijo o a la hija como hijo/a calificado/a, la persona elegible con el AGI más alto para el año puede reclamar el crédito.
    • Si uno de los padres puede reclamar a su hijo/a como hijo/a calificado/a, pero ninguno de ellos lo hace en su declaración, la persona elegible con el AGI más alto para el año puede reclamar el crédito si el AGI de esa persona es mayor que el AGI de cualquier progenitor que pueda reclamar al menor.

    Para los fines de estos criterios de desempate, un “progenitor” es solo un padre o madre biológico/a o adoptivo/a, no un padrastro o madrastra ni un padre o madre de crianza, a menos que esa persona haya adoptado al menor.

    ¿Cómo se reclama el Crédito Tributario por Hijos?

    Usa el Anexo 8812 (Formulario 1040) para calcular el Crédito Tributario por Hijos. Tanto la porción no reembolsable como la reembolsable se reportan en el Formulario 1040 (aunque en líneas diferentes). Cuando incluyas a tus dependientes en el Formulario 1040, marca la casilla “Crédito Tributario por Hijos” para cada dependiente que sea un/a hijo/a calificado/a.

    Si reclamas el Crédito Tributario por Hijos por error, y el IRS determina más adelante que tu error se debió a un “incumplimiento negligente o intencional” de las reglas del crédito, no podrás reclamar el crédito durante dos años. Si se determina que tu error se debió a un fraude, no podrás reclamar el crédito durante 10 años. Es posible que también tengas que pagar una multa al IRS

    Además, si el IRS rechaza o reduce tu Crédito Tributario por Hijos por cualquier motivo que no sea un error matemático o administrativo, por lo general, tienes que presentar el Formulario 8862 con tu declaración de impuestos a fin de reclamar el crédito para un año tributario posterior.

    ¿Puedes reclamar el Crédito por Otros Dependientes?

    Si no puedes reclamar el Crédito Tributario por Hijos por un dependiente, es posible que puedas reclamar el Crédito por Otros Dependientes. Si se cumplen todos los requisitos, este crédito se puede reclamar por dependientes de cualquier edad, incluidos los padres ancianos a los que mantengas. Sin embargo, no puedes reclamar el crédito por ningún hijo que califique para los fines del Crédito Tributario por Hijos.

    El Crédito por Otros Dependientes tiene un valor de hasta $500 por cada dependiente calificado. Sin embargo, al igual que ocurre con el Crédito Tributario por Hijos, se elimina gradualmente si tu MAGI es superior a $200,000 ($400,000 en el caso de contribuyentes que declaran en conjunto).

    Usa el Anexo 8812 para calcular el Crédito por Otros Dependientes (es el mismo formulario que se usa para calcular el Crédito Tributario por Hijos). Luego, la cantidad del crédito se reporta en el Formulario 1040 junto con la porción no reembolsable del Crédito Tributario por Hijos (si corresponde).

    ¿Cambiará pronto el Crédito Tributario por Hijos?

    La Ley de Empleos y Reducción de Impuestos (TCJA, por sus siglas en inglés) de 2017 introdujo algunos cambios significativos en el Crédito Tributario por Hijos. También creó el Crédito por Otros Dependientes. Sin embargo, los cambios y el nuevo crédito fueron solo temporales: estaban programados para caducar después del año tributario 2025. No obstante, en julio de 2025, el Congreso aprobó, y el presidente Trump firmó, el proyecto de ley One Big Beautiful Bill, que hizo que muchos de los cambios de la TCJA pasaran a ser permanentes en lugar de caducar.

    En algunos casos, como ocurre con el Crédito Tributario por Hijos, la nueva legislación aumentó ciertos créditos y deducciones. Para 2025, el crédito aumenta a $2,200 y se ajusta por inflación en años futuros. La nueva ley también hizo permanente la porción reembolsable de $1,400 del crédito, que se ajusta por inflación y es de $1,700 para 2024 y 2025. El límite de eliminación gradual ahora es de $200,000 para contribuyentes individuales y de $400,000 para contribuyentes casados que presentan la declaración de forma conjunta.

    TurboTax Online: Important Details about Filing Simple Form 1040 Returns

    If you have a simple Form 1040 return only (no forms or schedules except as needed to claim the Earned Income Tax Credit, Child Tax Credit, student loan interest, and Schedule 1-A), you can file for free yourself with TurboTax Free Edition, or you can file with TurboTax Expert Assist Basic at the listed price. Roughly 37% of taxpayers are eligible.

    Examples of situations included in a simple Form 1040 return (assuming no added tax complexity):

    • W-2 income
    • Interest, dividends or original issue discounts (1099-INT/1099-DIV/1099-OID) that don’t require filing a Schedule B
    • IRS standard deduction
    • Earned Income Tax Credit (EITC)
    • Child Tax Credit (CTC)
    • Student loan interest deduction
