    Crédito Tributario por Hijos en los años tributarios 2024 y 2025

    Para reclamar el Crédito Tributario por Hijos para el año fiscal 2024, debes determinar si tu hijo es elegible. Debes cumplir con estos siete requisitos:

    1) Requisito de edad.

    Para calificar, un hijo debe ser menor de 17 años de edad (a saber 16 años de edad o menor) al final del año tributario para el cual reclamas el crédito.

    2) Requisito de lazo familiar.

    El hijo debe ser tu propio/a hijo/a, hijastro/a o hijo/a de crianza a tu cargo debido a una sentencia judicial o por decisión de una agencia autorizada. Un hijo adoptado siempre se trata como tu propio/a hijo/a. (“Hijo adoptado” incluye a un niño/a que se encuentra a tu cargo por adopción legal, aun si esa adopción no es definitiva para el final del año tributario). También puedes reclamar a tu hermano/a o hermanastro/a. Y puedes reclamar a los descendientes de cualquiera de estas personas que califiquen, como sobrinos/as y nietos/as, si cumplen todos los demás requisitos.

    3) Requisito de sustento financiero.

    Para calificar, el hijo no puede haber proporcionado más de la mitad de su propio sustento financiero durante el año tributario.

    4) Requisito de dependiente.

    Debes reclamar al hijo/a como dependiente en tu propia declaración de impuestos. Ten en cuenta que, para que puedas reclamar a un hijo/a como dependiente, este/a debe cumplir las siguientes condiciones:

    • ser tu hijo/a (o hijo/a adoptivo/a o de crianza), hermano/a, sobrino/a o nieto/a;
    • tener menos de 19 años (o menos de 24 años y ser estudiante de tiempo completo durante cinco meses del año como mínimo o tener una discapacidad permanente, independientemente de la edad);
    • haber vivido contigo durante más de medio año; y
    • no haber proporcionado más de la mitad de su propio sustento financiero durante el año

    5) Requisito de ciudadanía.

    El hijo debe ser ciudadano, nativo o residente extranjero de los EE. UU. (Para fines tributarios, el término “nativo de los EE. UU.” se refiere a las personas nacidas en la Samoa Americana o en la Mancomunidad de las Islas Marianas del Norte).

    6) Requisito de residencia.

    El hijo tiene que haber vivido contigo por más de la mitad del año tributario para el que reclamas el crédito. Sin embargo, hay algunas excepciones importantes:

    • Se considera que un hijo que nació (o falleció) durante el año tributario vivió contigo todo el año.
    • Tus ausencias temporales o las de tu hijo/a debido a situaciones especiales, como escuela o universidad, vacaciones, negocios, atención médica, servicios militares o detención en un centro juvenil, se consideran como tiempo que tu hijo/a vivió contigo.

    7) Requisito de ingreso familiar.

    El Crédito Tributario por Hijos de se reduce si tu Ingreso Bruto Ajustado Modificado (MAGI, por sus siglas en inglés) supera ciertos niveles, que se determinan en función de tu estado civil para los fines de la presentación de la declaración de impuestos. Para los años tributarios 2024 y 2025, la eliminación gradual del crédito comienza con $200,000 en ingresos ($400,000 para casados que presentan su declaración en conjunto).

    Requisitos del Crédito Tributario por Hijos 2025-2026

    Crédito tributario por hijos para los años fiscales 2023, 2022, 2020 y anteriores (ver a continuación para 2021)

    Para reclamar el Crédito Tributario por Hijos para los años tributarios 2023, 2022, 2020 y anteriores, debes determinar si tu hijo es elegible. Debes cumplir con estos siete requisitos:

    1) Requisito de edad: para estos años tributarios, el niño debe ser menor de 17 años (es decir, 16 años o menos) al final del año tributario para el cual reclamas el crédito.

    ¿Qué pasa si el crédito excede mi obligación tributaria?

    Para los años tributarios 2025, 2024, 2023, 2022, 2020 y anteriores, el Crédito Tributario por Hijos estándar es no reembolsable. Si tu crédito excede tu obligación tributaria, tu factura tributaria se reduce a cero y cualquier crédito restante no utilizado se pierde. Sin embargo, podrías solicitar un Crédito Tributario por Hijos Adicional por Hijos reembolsable por el saldo no utilizado.

    Crédito tributario por hijos de 2021

    La Ley del Plan de Rescate Estadounidense de marzo de 2021 se diseñó para ayudar a Estados Unidos a recuperarse del impacto económico de la pandemia de COVID-19. Una parte importante del plan incluyó la ampliación del Crédito Tributario por Hijos para incluir a más familias, aumentar los beneficios financieros que brindaba y hacer que estos beneficios llegaran rápidamente a los contribuyentes elegibles mediante el uso de Pagos Mensuales Adelantados en 2021.

    Pagos anticipados del Crédito Tributario por Hijos

    Los cambios en el Crédito Tributario por Hijos para 2021 establecieron límites de ingresos más bajos que el Crédito Tributario por Hijos original. Las familias que no calificaron para el crédito utilizando estos límites de ingresos más bajos aún eran elegibles para el crédito de $2,000 por hijo utilizando el original.     ¿Cómo ha cambiado el Crédito Tributario por Hijos a lo largo de los años?
