OVERVIEW

La Ley del cuidado de la salud accesible o a bajo costo, también conocida como Obamacare (Ley del cuidado de la salud Obama), introdujo tres nuevos formularios de impuestos relevantes para individuos, empleadores y proveedores de seguros de salud. Son los formularios 1095-A, 1095-B y 1095-C. Estos formularios ayudan a determinar si necesitas cumplir con el nuevo pago de responsabilidad compartida, es decir la cuota que tendrías que pagar si no tienes seguro de salud. Para las personas que compraron seguros a través del mercado de salud, esta información ayudará a determinar si puedes recibir un crédito de impuestos por la prima adicional o si tienes que pagar algunos impuestos de vuelta.


Pago de responsabilidad compartida

Cualquier interrupción por elegibilidad de la cobertura de seguro de tres meses o más para ti o tus dependientes puede requerir que tengas que efectuar un pago por la responsabilidad compartida individual. Esta información se reporta en tu declaración de impuestos y se obtiene de la información que proporcionas y la que se proporciona en los formularios 1095.

Puedes estar exento de este pago si, por ejemplo:

  • Tu empleador no ofrece opciones de cobertura accesible o a bajo costo.
  • La falta de cobertura de seguro es de tres o menos meses consecutivos.
  • Tu perteneces a un grupo que está explícitamente exento de participar en la Ley del Cuidado de la Salud Accesible o a Bajo Costo por el Servicio de Impuestos Internos (IRS, por sus siglas en inglés). 

Formulario 1095-A

Las compañías de seguros que participan en los intercambios de cuidados de la salud deben proporcionarte el formulario 1095-A, una declaración del mercado de seguros de salud. Este formulario incluye:

  • Tu nombre
  • La cantidad de cobertura que tienes
  • Todos los créditos fiscales a los que tenías derecho
  • Si los usó para pagar tu seguro de salud y la cantidad que pagó por la cobertura

Se utiliza esta información para que completes tu declaración de impuestos, ajustes cualquier pago de crédito fiscal y reclames cualquier crédito fiscal por primas que puedas deber.

Formulario 1095-B

Los empleadores con menos de 50 empleados de tiempo completo que ofrecen cobertura de salud, así como proveedores de seguros de salud, envían el formulario 1095-B a los miembros de sus planes de seguro de salud, a partir del año fiscal 2016. Este formulario incluye:

  • El tipo de cobertura que tienes
  • La cobertura de tus dependientes
  • El período de la cobertura

Este formulario es utilizado para verificar en tu declaración de impuestos que tú y tus dependientes tienen por lo menos Cobertura Esencial Mínima (MEC por sus siglas en ingles). Si tuviste una interrupción en las coberturas de atención médica para el año fiscal, puede que tengas que efectuar un pago por concepto de la responsabilidad compartida individual.

Formulario 1095-C

El Formulario 1095-C, La oferta y cobertura de seguro de salud proporcionada por el empleador, muestra la cobertura que te ofrece tu empleador, a partir del año fiscal 2016.

Es utilizado por grandes empresas con 50 o más empleados de tiempo completo o el equivalente de tiempo completo. Este formulario proporciona información sobre la cobertura que tu empleador te ofreció y si tú eliges o no participar. Puedes usar este formulario para completar tu declaración de impuestos.
