Cómo Reclamar Las Propinas En Tu Declaración De Impuestos

Si ganas propinas, eres responsable de pagar los impuestos, seguro social y Medicare con el dinero de propina que recibes.


Para el IRS (siglas en inglés de Servicio de Impuestos Internos), las propinas son ingresos gravables al igual que los salarios. Si ganas propinas, eres responsable de pagar los impuestos, Seguro Social y Medicare con el dinero de propinas que recibes. El IRS requiere que tu empleador retenga suficiente dinero de tu salario; sin embargo, la cantidad retenida se basa en el total de tu salario más el ingreso de propinas que informas, incluso si recibes las propinas en efectivo directamente del cliente.

Paso 1: Anota los ingresos de propina que te ofrecen

El IRS requiere que informes de tus propinas mensuales totales a tu empleador antes del día 10 del mes siguiente. Si tu empleador no tiene un proceso para reportar ingresos de propinas, puedes usar el Formulario 4070. Si no reportas tus propinas a tu empleador, el IRS puede imponer una multa equivalente al 50 por ciento del impuesto de Seguridad Social y Medicare que no estas pagando.

Tu empleador pasará tus cifras al IRS y sacará dinero de tu salario para cubrir la retención de propinas. Si no ganas por lo menos US$20 en propinas durante el mes, no tienes que reportar las propinas a tu empleador. Si trabajas en más de un trabajo, aplica el límite de US$20 a cada uno. Sin embargo, todavía tienes que incluir estas propinas en la base gravable cuando prepares tu declaración de impuestos.

Paso 2: Mantén un registro de las propinas que pagas, compartes o acumulas con otros empleados

Puedes reducir la cantidad de tus propinas reportables si compartes algunas de ellas con otros empleados. Por ejemplo, si recibes una propina de US$125 y le das al ayudante de camarero y al barman US$35, entonces sólo tienes que reportar US$90 en propinas.

Paso 3: Revisa tu W-2 cuando lo recibas

Si no ganaste lo suficiente con los salarios y propinas que tu empleador te paga directamente para cubrir tus retenciones de impuestos, el W-2 mostrará la cantidad de impuestos que aún debes. Si la cantidad que debes es considerable, puedes ser responsable de las sanciones fiscales estimadas después de presentar tu declaración de impuestos.

Paso 4: Llena el Formulario 4137 para cualquier ingreso de propinas no declaradas

Esto cubrirá los meses en que el total de tus propinas son menos de US$20, así como el valor de las propinas que recibes que no son en efectivo. Suma esta cantidad a tus propinas declaradas y los salarios para obtener tu ingreso gravable total. El Formulario 4137 incluye las instrucciones para el cálculo del impuesto de Seguridad Social y Medicare que debes pagar por tu ingreso de propinas no declaradas.

Advertencias:
El IRS asume que los restaurantes y empresas similares generan propinas equivalentes al menos al 8 por ciento de las ventas. Si una empresa sólo informa propinas anuales iguales a 6 por ciento de las ventas, por ejemplo, el IRS exige que el empleador asigne el 2 por ciento restante de las ventas entre los empleados, y debes incluir tu parte en el ingreso gravable.
