Can the non-custodial parent file as Head of Household?

I am a non-custodial parent of three children. Our divorce stated that I can claim two of the children as tax exemptions for 2008. However, since the children didn't physically live with me for more than half of the year, it doesn't appear that I can file as Head of Household even thought I can claim two of the three children as exemptions. I meet the other tests of Head of Household. If I have to file as Single, my taxes are higher.

No - to claim HOH, the child would have to live with you for more than 1/2 of the year.
