Federal 2010: Passive Activities and Spouse's Credit for Small Employer Health Insurance Premiums
Certain customers, who were Married Filing Joint and the spouse had a Credit for Small Employer Health Insurance Premiums from a passive activity, may have filed an incorrect tax return.
TurboTax has fixed this issue.
How to tell if you are impacted:
You may be affected if ALL of the following are true:
- You filed a tax return prior to March 17, 2011, AND
- You filed Married Filing Joint AND
- Your spouse was a Limited Partner in a passive activity and had a pass-through of a Credit for Small Employer Health Insurance Premiums, AND
- Your spouse’s credit does not appear on the Federal Form 3800, Part II, Line 29h.
If you are affected, you may have overpaid your federal tax. You will need to amend your federal tax return.
