New York 2010: Nonresident return and other income allocation

Certain customers who filed New York nonresident tax returns that included “other income” taxed in New York State, may have incorrect tax returns.

This issue has been fixed.
 

How to tell if you are impacted:

You may be affected if ALL of the following are true:

  1. You filed a 2010 New York nonresident tax return prior to May 10, 2011 AND
  2. Your federal return included an “other income” amount (see Form 1040, line 21) AND
  3. You indicated that the “other income” was derived from New York sources, therefore taxable to New York state AND
  4. The “other income” amount was not included on your New York Form IT-203 (Nonresident and Part-Year Income Tax Return), line 15 “Other Income” in the second column titled New York State Amount.

If you are affected, you may have underpaid your New York tax. You will need to amend your New York tax return.

  1. Please download and print this Authorization Form.
  2. Complete the form and fax it to us at the number printed at the top of the form.
    • Note: After we receive your completed authorization form, please allow up to 15 days to amend your return.
  3. You can print, sign and mail the corrected return to the New York State Department of Taxation.

Or you can make the corrections yourself. However, the amend process can be complex.
