New York 2010: Education Expenses for Nondependents...
Certain customers, who entered education expenses for a student who was not a dependent, may have an incorrectly received the education deduction or credit on their New York tax return for which they were not qualified.
This issue has been fixed.
How to tell if you are impacted:
You may be affected if ALL of the following are true:
- You filed a 2010 New York tax return between March 5, 2011 and March 18, 2011 AND
- On your federal tax return, you entered education expenses for undergraduate tuition expenses for a student AND
- The student was not you and/or your spouse AND
- The student was not listed as a dependent on your tax return
Note: The student’s status on TurboTax’s Dependent Summary screen was “EIC or Care Credit Only”.
If you are affected, you may have underpaid your New York state income tax. You will need to amend your New York tax return.

- Note: After we receive your completed authorization form, please allow up to 15 days to amend your return.
- You can print, sign and mail the corrected return to the New York State Department of Taxation.
