Delaware 2010: Railroad Retirement Benefits

Certain customers, who received Tier II railroad retirement benefits on a Federal 1099-R, may have filed an incorrect Delaware state tax return.

TurboTax has fixed this issue.

How to tell if you may be impacted

You may be affected if ALL of the following are true:

  • You filed a 2010 Delaware Income Tax Return prior to February 14, 2011; AND
  • You received Tier II railroad retirement benefits on a Federal 1099-R that were taxable on your federal return; AND
  • The taxable amount does NOT appear on your Delaware Form 200-01, Line 36c, as a subtraction from federal adjusted gross income.

If you are affected, you may have overpaid your state tax. You will need to amend your state tax return.

  2. Complete the form and fax it to us at the number printed at the top of the form.
  3. A TurboTax representative will contact you (within 15 days) when your corrected return is ready to be securely emailed back to you.
  4. You can print, sign and mail the corrected return to the Delaware Division of Revenue.

Or you can make the corrections yourself. However, the amend process can be complex.
